So, I was arrested and charged for assault with a weapon on Wednesday. My older brother is a junkie, a complete waste of space. The last time I talked to him, was Nov 3, 2013 when he got a Facebook account. We lived in different provinces. Before that, the last time I talked to him was about 15 years ago. Anyway, it turns out he is still a junkie and liar so I dropped him from my friends list. This past January, I move back home, the same town he lives in. I do not go see him or talk to him. On Monday, I get home from work and there are all these threatening messages from him. Saying he is going to put me in the hospital blah blah. So I tell him to send me his address and I will come down. I get home from work the next day and he has sent me more threats of hospitalization along with his address. Well I went down there and he is the one who was sent to the hospital. lol. I get charged but I am not worried. I have the threats on Facebook, he has also verbally threatened me to other people and I can fill that court room up with character witnesses and he won't be able to find anybody. lol What a loser.
I get why you did it but it would of probably been best if you just stayed away, assualt convictions normaly result in making it difficult to get a job. You do not want to fuck your shit up because of some waste of space as you say.
What weapon did you use? If you just used your hands you shouldn't have much to worry about..but if you whacked him a few times with a baseball bat you might get in a little trouble
The fact you asked for and then went to an address shows you escalated the situation and the judge will say go to the police when you're threatened... Should have just let it go...
If he's a complete waste of space dude he's not worth an assault charge. I get it, my brother was a complete piece of shit for over 10 years. But that's on him. Don't let his shit get on your boots.
Is what you are charged with a misdemeanor or felony in Canada(or wherever you live)? See if you can go through pti or something if you haven't been arrested before

Dame dude its one thing to teach your big brother a lesson but dame man you sent him to the hospital as someone said the fact you went there. Is what has fucked you, you should have went to police thats what the judge is gonna say

Ya I understand why you did what you did but you shouldn't have asked for the address on Facebook because then it makes like your escalating the situation. Your not going to get the best legal advice from people here so I would definitely lawyer up if you haven't already because a felony assault and battery conviction will make it hard to get a job in the future. You're not allowed to use force against somebody because of words, especially when they're not even present - but you already knew that and went ahead with it anyway. I highly doubt that somebody who is a junkie meant what he said when he issued those threats.
Naw I'm still here. Court is Aug 7. I completely forgot about this thread. lol I'm not going to get into details about what I did. Nothing too serious. I am taking this all the way, judge and jury. I can fill that courtroom up with character witnesses, my bro won't be able to get a single person. I have evidence of his threats. I imagine the prosecutor will offer a reduced charge instead of dragging this through court with all the evidence I have. She has been cool with me so far.
