Anybody Ever Have An Expungement Hearing?

  1. I got a possession charge when I was 18. First and only drug offense. I'm 26 now and job hunting, so I wanted to get that expunged. I wrote my letter to the court and got a court date for the hearing. Anybody ever have to go to one of these hearings? I was just curious what to expect. Am i gonna have to give a speech about how much of a model citizen I've been since then (lol). Or will I just have to go in and the judge tell me whether or not it'll be expunged?
     
  2. You'll probably just be judged. My buddy got his possession of hashish expunged but that was during the whole ordeal and it was like felony 1/5 he was having to deal with lol

  3. just wanted to give an update incase anyone does any searching on this subject and comes across this thread. I had my hearing today. Took 2 minutes. Went in front of magistrate without a lawyer. Two guys represented the state of ohio. Magistrate just called out what I wanted to do then asked if the state had any objections...One of the guys representing the state fumbled around some papers and then said we have no objections towards the expungement. Magistrate asked if I had anything to say. I just said a bunch of stupid stuff like graduating college and buying a house and cleaning my act up. Then the magistrate said if the state has no objections then I hereby order the file to be sealed. I signed two papers, one saying I appeared in court in front of the magistrate and the other saying the file will be sealed. And that was it.
     
  4. thats awesome dude, may be weird but i must say congrats i also have a possession charge from when i was 18 i would like to have expunged eventually. did it cost you any money? you just sent a letter to the court and they replied via snail mail with a court date? did they give instructions?

    I also would like to know if it costs any money.  I have a Possession of controlled substance and my case got continued, I'm on supervised probation until sentencing in June.  My plea deal was I get probation or a fine at sentencing and at the end of it, it would automatically be expunged. I hope this doesn't cost money

I went to the courthouse clerks office and picked up a form that I filled out with case number and shit like that and the paper had space to write my letter and then it costs $50 to get that paper filed. But after that it didn't cost anything. The law says A year had to pass after my probation period was over and I could only have one offense. But I didn't even get put on probation for the possession. It's just a minor misdemeanor in ohio.

    AZN you might not have to file since the expungement was part of your plea deal. I would check with your lawyer or probation officer on that one.
     
  7. Also some counties in ohio had the form on their court website that you could print off so you didn't have to go pick it up but you still had to give it to the clerk and pay the $50
