Am I shit outta luck?

  1. Ok so tonight I was at work and I deliver pizzas and I was driving my moms 07' Nissan Altima, someone bumped into the left side of the car and at the time I wasn't sure who it was, I mean I was pretty sure but wanted to believe the kid cause I like him as a worker and hes a good guy.
But after you look at it its obvious he did, my moms car got hit on the left side where the doors come together and there is red paint on it, and silver paint on the kids red truck on his rear right bumper, so I know he did it. He will not admit it, but if he did do it this isn't the first time, about 1-2 months ago he SCRAPED the side of my bros car and took the whole side molding off with it and he did admit it then but my bro being the nice guy he is didn't really make a big deal of it, he has two cars, a G35 and a escort as his delivery car.
I didn't think it was a big deal and insurance would cover it (full) but I didn't know how full coverage works until later tonight with the deductible and all that bs.

Well now my moms telling me someones paying it and she thinks it'll end up having to be me cause the kid will not do it and its to late to get police involved and I also cleaned it up a bit took the paint off the car so now thats no help, but all the other people who saw it agrees it was him and the GM of the store too...
If its not too late and I do get cops involved its ok that I was driving her car right, we are on the same insurance and all.

And yes I have my own car but its getting a new engine dropped in it right now.

  2. Yes it's fine that you were driving her car, as long has you had her permission and have a valid license (which I assume you do).
What you could do is take him to court, with that evidence you could easily get him to pay.

Make sure you preserve the evidence as best as you can, and tell that kid not to clean up his truck. Also take pics for evidence.

  3. Me being the dummy I am I cleaned her car up so it looks almost good as new (the damage isn't that bad but paint is gone).
And I doubt he will clean it up, my buddys black paint from his escort is still on the front right bumper, i'll take pics with a good camera, my other coworkers are saying it had to be him, even my general manager.
And yes I have a valid license, 3 years no wrecks nothing but speeding tickets.

I'll be calling the local PD tomorrow tell him the story and see what I can do, but I was real stupid for cleaning his red paint off my moms car...damnit.

  4. That shouldn't be a huge deal. The fact that you have paint missing, shouldn't be a huge deal The paint from your moms car can be found on your co-workers truck and (if it comes to it) can be tested and verified that it came from your moms car.
That however may be going too far. You have co-workers they may be willing to testify against him in court (again, if it comes to it).

I would say you have a pretty solid case. And if you threaten to take your co-worker to court and tell him you have an air-tight case, chances are he might just fork out the dough instead of having to pay the lawyer fees and what not.
