Advice on MJ legal issues. How I worked the system. A Must Read.

    Hello GC. :wave: Im from Missouri. A state that although isn't too strict with the possession laws. It currently does not recognize any medicinal value for MJ as an excuse in court according to NORML although Im sure that varies.

    I am compiling advice which GOT MYSELF out of TWO MARIJUANA CHARGES. One for carrying 7.3 grams and a pipe at school. And the other for getting caught with 2 plants shortly after moving from my house to an apartment. I will go into detail later, but forgive me for the advance bitterness.

    I am doing this out of my concern and help for the people on this site. If you want hard proof that these tactics worked, I don't have that. I'm sorry. Either believe my word and hopefully find a way to utilize what I am about to tell you or FUCK OFF. Also I wasn't caught with a scale or 5+ plants or smuggling pounds in the trunk of my car. This is more so aimed at the people who are involved with smaller related cannabis charges. But anyone can find this beneficial.

    Now I am almost 20 years old now. I unfortunately grew up in and out of group homes, state facilities, juvenile detention centers and the occasional phychward because, as we all know our government likes to intervene in our lives and try to decide the path our lives go through. What I took for a cursing and granite is now what I consider a blessing. Those experiences and places are a system just like the ones such as prison and jails but on a smaller scale.
    To get out and stay the fuck out, I was once told by a police officer who recognized the hypocrisy of many of our own laws that "This is all one big fucked up game. Learn how to play it and your home free."
    So I learned how to lie, manipulate and become articulate with words. (Tip one) Educate yourself, it takes no effort to pick up a dictionary or thesaurus and build your vocabulary. If you ever fall in the unfortunate circumstance where you have to explain yourself to the law. It does help to have a nice vocabulary and break the "Stoners are brainless morons" stereotype. The power of words is often greatly underestimated.

    Now my first incident happened when I was 16 in high school. Unaware I had been ratted out by a fellow classmate. I found myself called down to office thinking I was to be written up for skipping or something else.
    Instead I found a police officer standing next to my principal. They started asking me questions: "Do you have anything illegal, ect,ect on you?" The predictable interrogation bullshit. The police officer asked the principal to step outside while he searched me. This was his mistake. (Advice two) When you and an officer are somewhere with NO CAMERA'S, NO Second eye witnesses, NO Voice Recorders or anything to document what happens behind closed doors, your word can have just as much leverage as theirs. Police can and do lie. And If the opportunity allows it you can and should. Now before I proceed I would say this is Defiantly not as useful as the second part of advice I will give.

    So after he started yelling and trying to intimidate me. Probably within no more then a minute after the principal left. I screamed at the top of my lungs "Help get off me!"
    My principal came bursting in, I took a huge step back from the officer and said "He grabbed my fucking balls"... I shit you not. He didn't but that doesn't matter.

    The principal insisted he leave the room. The police officer was so dumbfounded by what I just did he was at loss for words. So he radioed in another officer. He searched me, found the paraphernalia and marijuana. I was handcuffed and taken to the station. The whole time I never answered a question about my contraband. Anything out of my mouth was about the officer fondling me. Don't blab 24/7 about it. Remember your under arrest and the less that comes out of your mouth the better.

    So upon arriving to the station I was questioned by a higher ranking officer. He asked me about the weed and pipe and I deterred the conversation topic completely. Out raged I demanded to file a grievance form/ complaint on what the officer had done to me. He asked me why his officer would do something like that. My reply was "He grabbed my groin and told me if I didn't hand over the contraband alot more of this would happen where I was headed." I followed with my demands again. He came back, told me their would be no charges and I was free to go whenever my parents came and picked me up.
    There are two obvious reasons for that.
    1.Whether Its a lie or truth, no police station wants to risk having "So and So fondled by officer" reach the media or become news in the community in general.

    Secondly (this is a beforehand fact I knew which helped me). All police have track records that follow them through out their whole career. Once a grievance or complaint is filed. It follows that officer on document forever. Regardless of the truth or not. This can put officers on paid/unpaid leave. Have them fired and also cripple them from finding work in other departments or moving up in rank.. Most people complain about being punched, tased or hit ect. This is ineffective! Police have the power to use brute force while not suffering consequences simply because it doesnt hold the same negative calibration/outlook from others as saying you were fondled.
    Charges Two.

    Now I actually went to court for this, spent two nights in county jail. Payed $1250 bail, and had to hire a public defense attorney. I was roughly a month from harvest but lost my house to foreclosure and had to move into an apartment. I had 2 plants, roughly around 3 feet tall each. I had a bad feeling about moving them. I made the mistake of carrying them into my new complex during the day with people out and about.
    They were well hidden in storage bins, but the smell was so damn strong. I really hoped no one would notice and if they did they would let bygones be bygones. Obviously you should never assume this. I was careless.
    It turns out some lady, my ex-neighbor (I moved far the fuck away from that complex)
    who was outside when I was transporting the plants was a police officer. My fucking luck right? Four or five days later after sweating balls over it, my worst predicament comes true. That bitch neighbor and another officer are knocking on my door with a warrant.

    I confess where the plants are, and let them know in advance I have no weapons or any other illegal substances in the house hold. WOOOHOO my second trip to jail only two years later. (this was only 5 months after my 18th b day)

    Okay so your thinking, how did I get out of this?
    Firstly, after I posted bail. When meeting with lawyers I did my absolute best to find one who knew what he was doing, reliable and would let me have involvement with defending myself. I found one who was open to what I had to say, let me educate him and give him sources. This is important.
    Secondly this I believe is the factor that really kept me out of prison. It allowed my lawyer to attest to my morale and character. It gave him ground to tell the courtroom I was as beneficial and productive as a member of society if not more so then others.

    I get involved with charity or community service (non mandatory) at least once every two months.
    Why?
    Because I like helping people and the environment, plus I had a feeling this could benefit me against any future criminal charges. Its an alibi that I can say I enjoy. I really love smoking a joint before helping clean a park or restore a building or running for cancer. Very uplifting and can make outdoor experiences sooo enjoyable.:smoke:
    Now I remember when my lawyer explained to the courtroom about my helpful involvement everyone seemed to open their eyes wide and kinda turn their head.
    Like "This person was really growing weed?"
    I ended up getting 5 years probation, 500 hours of community service (it was a felony none the less) and mandatory random drug test.

    Another thing was, I cried and cried even though I knew I really did nothing wrong. If your good with water works. Do it. Most of us are wired to feel sympathy at the signs of pain of others. Its human nature. And if alot of tears can bring even a little sympathy, that is still something that could be on your side.


    My lawyer was shocked at the amount of leniency shown towards me. Cultivation of Marijuana where I live comes with possibility of up to 7 years in prison. And a fine up to $5000. He believes because of my deeds as a good citizen (the charity work) I was let off easily.
    Although tough laws are still in place, I feel bias towards MJ users is declining.

    My advice is put the bong down for a bit, and go get involved with a charity of your choice or sign up with a program that benefits your community.


    Because not all of us can cry "cop grabbed my balls".
    Yeah the government and even society can be a pain in the ass.
    But Im not rotting behind bars now, and I know why. Maybe the change shouldn't completely start with passing new laws or anarchy or some other mountain to climb.But Instead with doing work that changes peoples attitudes towards yourself, that way you can have real ground to fall on.
    Because the medical MJ argument although valid will always be a tough one, esp. when your not terminally ill and other legal medicinals are an "unwanted" but none the less option.

    This is all I have to say and hopefully you've found something in here worth your time and beneficial.

  2. what class felony is 2 plants in your state? cause i caught a class 4 felony and all i did was get 2 years probation and 25 hours community service.

    course now i've got a 2nd class 4 and i'm going away for it most likely but thats the game.

  8. thanks for the replies guys. And theirs defiantly alot more loopholes then people know about. Weather its a cop or judge, I think people forget were all humans and anyone can be manipulated/persuaded/ or taken advantage of as awful as that sounds haha. Just dont let fear rule you. Intelligence over emotion guys :hello:
