3 Friends, Pulled Over, Arrested, 1 Bowl, 2 Pipe, 6 Cops, 1 Dog, Help?

    Two buddies and i were pulled over for driving a few blocks out of a parking lot without headlights. We live in Washington state. I'll just explain our names by age.. I'm 18, one was 19, and one was 17. I was in the back seat and my two other buddies were in the front. 17 was riding shotgun and 19 was driving. 17 throws his bud on the floor behind him(in front of me). and so i pick it up and throw it back and he put it in the glove department with his pipe. When the officer shows up to the window he ask what i had grabbed off the ground. all there was was alot of fast food wrappers, other junk, and air freshener. so i had to say air freshener. now we didnt smoke any pot for atleast 4 hours in the car and we didn't really use air freshener. The cop says it smells like weed and air freshener and pulls 19 out of the car and asks his questions. 19 says he knows nothing of any bud in the car. so he puts the cuffs on and puts him in the car. by now there is 3 cop cars around us. they pull me out and start questioning me. saying im the one with the pot and im going to go to jail if no one fesses up. I dont say anything, and the cop keeps harrassing. and 17 yells out the window that he has the pot. the officer got the pot and talked to him. while the other put the cuffs on me and said i was going to "big boy jail", and put me in a different car. 17 just gets put in the back of a car without any cuffs. 10 minutes later 3 more cops had shown up. one was a k9. they searched the whole car and only found a pipe in the driver door. after an hour into it they start writing out tickets. they give 19 a ticket for driving without a light on and possession of marijuana, although he only had a pipe. they gave me possession of marijuana, and i was the only one with drugs on me. and all 17 got was a free ride home and no charges even though he got caught with the weed and a pipe. they called 19's parents instead of impounding the car and just asked how i was getting home. leaving me to find my own ride.

    I have to go to court now. so i was wondering if it was easy to get the charges dropped since i had nothing on me and got charge.

    also, me and 17(one with bud) have the same first name, so it could be possible they mixed us up.

    I am the most "stoner" looking one out of the three of us.

    What can i do?

    Talk to 17, make sure you have the EXACT same stories. Someone has to get thrown under the bus. They found it, and one if not both of you will be punished. Try to get 17 to confess and make you seem innocent (which you are), and things will be OK. If it really was his, then he should do that for you.

    Or, you could both fess up and both get probation (the most probable punishment, assuming neither has a record). Good luck with whatever happens!

    The best thing you could do would be to get a lawyer and try to figure it out from there and you def. do not wanna just start confessing to shit if you don't want to!!!!!!.. Sadly I really doubt you will be able to have that charge dismissed but it is possible!! You can get it expunged off your record.. you can do that one time and you would more than likely probably not get more than some community service hours:D:smoking:

    you need to contact the 17 yr old guy and have him say it was all him, the worst thing that can happen to a 17 yr old is a slap on the wrist and maybe probabtion for like 3 weeks tops. you and the 19 yr old can get in more trouble than him and it will be on your permanent record, he most likely can get it wiped from good behavior. plus if it was his shit anyways he needs to take responsibility, if not you need to bust some skull. naw what i mean.

    Wait, am I reading that they cuffed 19 before finding anything, other than a suspected scent. Smell can be just cause for a search, but as long as he didnt physically resist them searching and was compliant he should not have been cuffed. He should talk to a lawyer about this, and of course so should you and 17, always consult a lawyer pre-trial, and of course talk with your friends to line up the story. I don't know everyones situation and what not, but if 17 is the one getting the most heat, that might be best left as is. He will soon be 18 and will have a clean slate. You and 19 would have to have this expunged from your record , and even than only if you are not found guilty.

    Sadly the system does not work like this!!! If he turned 18 in between now and his final court date then he would be charged as an adult! You def. can not just have him say it was all him!!! Best thing to do in all cases is to get a lawyer if possible!:smoking:

    dont waste your money on a lawyer for your first time offense! what are you ripped let the system do its job nobody is gonna send you to jail. public defender dude.

    ur friend 17 ruined it for you guys by confessing for having the weed...you could of gottn out of that damn sorry to hear..ive done the same:mad:

    get a good lawer and clean ur self up u dont want to be in cort lookin like a stoner, good luck. u must be in a small town 6 cops for bud means they dont have shit to do

    When you are over 18 the cops cant call your parents.... What the fuck is that shit, I dont know why he let them do that.

    As much as it is for the homies, legally... it's smarter for the 17yr old to take the wrap. He'll understand next year. The worse person in this deal is the 19 yr old because he was driving. Not sure how they are with the laws in Wash State, but the quote above is correct, the 17 yr old gets it easiest legally (not saying his parents can't rip him a new one or somethin).

    :DLol I believe the police can do just about whatever they feel is neccessary legal or not... Also the 17yr old can't just take the wrap.. your all charged with something and had something to do with it so you might as well be prepared to deal with it! You more than likely won't get any jail time but if you got a lawyer this would ensure that!! :smoke:

    First off get a lawyer. With Washingtons laws it would be better to get an attorney. Plus I believe you have to meet a certain income level in order to get a public defender, but onto your problem.

    Once you have gotten your attorney have your friends meet with him so everyone gets on the same page and he can get all the details of the search. It is possiable the cops could have messed up their search and then all evidence is thrown out.

    Your best bet is to get a lawyer. First though try and meet with your local district attorney. It is possiable that you might be able to clear everything up without getting a lawyer. (that is of course if I am understanding you had no weed on you and they cannot prove beyond a doubt that you handled the mary jane)

    The key is to get a lawyer. Shop around and maybe ask some local stoners if they have any suggestions. Or go to norml they do have a list of attorneys by state that are pot friendly.

    im in about the same boat as you man. my underaged friend agreed to take the heat (he should it was his) and my lawyer said that and a clean dt should be enough to get the charge dropped for me. she also said since hes underaged and didnt get written up for it they shouldnt even bother getting him and punnishing him

    Probation isn't that bad, I paid for my brothers lawyer and he ended up with (and I don't remember the legal term) a really light probation. One meeting after six months and no drug tests or service hours, the public defender he had talked to said that he would probably lose his license and have hours/drug tests. So please, if you can, get the best lawyer your money can find.

    What if I have no chance of getting a lawyer? I've never been to court, or been in trouble so I have no idea about it. Would it be as easy charge to fight alone? If I brought the friend that was caught with the bud to help, would it change anything?

    If you have no chance of getting a lawyer then try and go for a public defender.. You can bring your friend to court if you want to but its better just to have the public defender talk for you to the judge! It's really nothing to worry about just be very nice to the judge and you will probably just get probation or some fines!:D
