  1. Headshops in canada are soooo much cheaper than the ones around me. I bought a bong there a few months ago, just shot it in my trunk and made it through with no issues. But i dont wanna do that again, i dont want my piece taken and smashed, or end up with charges. Anyone know what the rules are on this, ill be coming back over through ny. I suppose i can always ship it, but then i still run a good chance of it being broken. Anybody have any ideas for me?

  2. I wanted to bring a bong from US to Canada and im in the same boat.

    :(

  3. I think only the resin in the device is what gets you in trouble. If you could completely clean the bong without a trace of anything, wouldn't it be legal?

  4. i'm pretty sure if it's an unused bong you can bring it anywhere. it could be a tobacco bong, right? i'm really not sure about border rules, but i know that if you're caught in canada with an unused bong they can't do aaaaanything about it. unless bringing tobacco pipes/bongs into the USA is illegal, you should be fine. when i went to amsterdam i brought back lots of pipes (clearly for weed, but unused) into the states and they didn't even say anything.

  5. Just don't smoke any weed out of it, maybe buy some tobacco and just have pipe tobacco in your car with it. That way they can't really say its paraphenalia.

  6. hate to revive his but....

I forget the specific wording but the law is essentially this:

"Anything that might be used for the preparation, consumption, inhalation, etc, etc etc.... of illegal substances."

The one word I remember being used 100% was "might be".  Meaning that the customs agent your dealing with gets to make the ultimate decision on whether or not you are fined, imprisoned, or get a slap on the wrist.  If you have a strong enough case that it was used for only tobacco (OR if you have a strong enough case to show that it is "glass art" and not "paraphernalia) they might just let you go with your piece in peace.  But in the end, it's up to some A-Hole with a power trip.

Drug Paraphernalia is illegal to bring across the border, and the definition for what is considered part of that category is extremely vague.  It does mention bongs and water pipes in the definition, however it's been a while since I've seen the actual regulation in writing.

I have a theory that they do this because it really does give the customs agents a lot of power.  They can decide on a whim to let you in or not.  Im a dual citizen so I've traveled across the border a lot with relatively no problem.  Although if I ever forget paperwork they give me a really hard time (I've been threatened with deportation a number of times).

People have gotten fines upwards of 3k for stuff like kinder surprises.

Paraphenalia is a special class of items. If you have one in order to smoke anything in the world except Pot, it is a legal item; if it's used (or will be) for Pot, then it is illegal.

That's not quite the proper test.

The question is whether there is 1) an intent to use the pipe for an illegal substance; 2) knowledge that it will be used for an illegal substance; or 3) it's designed to be used for an illegal substance.

And these factors can be inferred very easily. At the very least, you can always be charged for it.

Bottom line: You should assume paraphernalia is illegal.

    PS - I'm a criminal defense attorney.
</div>best answer to this question I've ever seen.  Can't comment on this guy is actually an attorney but those 1,2,3s are what the customs agents are asking themselves to decide whether or not to punish or let you through.

  8. Next time you cross the boarder watch how many cars get shaken down, the numbers seems really small. I have gone back and forth with "contraband" and never been caught and only really questioned once. Boarder guards are federal workers who have a thankless, pointless and an impossible job to do most times so unless you fire them up most will just go through the motions. On the other hand if you show up at the wrong time, with the wrong vehicle and with the wrong attitude you can be there for hours.

  9. Just mail it from Canada to your place in U.S.

  10. And print off a sticker saying for tabacco use only and have that sealing the bouble wrap. Its what shippers like GC, do

  11. Yeah dude, completely legal, they say in the shop that they're for tobacco use only
