Medical Marijuana and Felonies

  1. Someone I know got busted awhile back for manufacturing with intent to sell marijuana, which resulted in a felony, and my buddy was wondering if he can still get a medical card?

    In Michigan, yes. That is, if they are looking to be a patient.

    Caregivers are not allowed to have a drug related felony on their record.

  3. In almost every medical state, a patient can get a medical card. To become a caregiver, it depends on how the state determines a drug felony. As in Michigan, almost any prior drug felony regardless of how old, will prevent a person from becoming a caregiver. I other states they varie from 7 yrs to 20 yrs. It is best to check your states laws on drug felonies.

    As for a medical patient and medical card, it does not matter, it would be unconstitutional to reject a person w/ a medical problem b/c they are a convicted drug felon while allowing other persons w/out felonies that have the same illness medical access.

    I'm hoping congress will pass the 2087(I beleive that is the bill) which will allow reclassification of marijuana for medical use.

  4. Speaking from personal experience, yes, you can have a felony on your record and still become a MMJ patient.
     
  5. What if you have a felony in another state other than the one you trying to become a caregiver in? Do any states allow that? If so which? thanks
     
  6. I'm in the felon group myself. Got pinched for cultivation and trafficking. Never sold anything just based on the amount I was in possession of was the basis of my trafficking charge. Aint that a bitch? U can't be a caregiver if a felon but u can be a patient. Which in that case u can grow. Just get a few " roomates" and post their licenses outside ur growroom. Then u aren't caregrowing. It's a "shared" garden.
     
  7. A dude I once knew not only got busted for a "few too many" (couple of 100) plants, but when he ended up on probation, he was allowed by the judge to continue using cannabis and grow for PERSONAL use (but not hang with his former growing buddies).

    In California, a "pot doc" may ask you if you have been busted previously, but most just consider prior cannabis use as just "jumping the gun" and self-medicating. No prob!

    So i got pinched selling a sched 1 substance( Psilocybin) in TN. I was eligible for and accepted a diversion which came with a price of eighteen years state probation. My lawyer told me that I was technically not convicted, in case that matters. What I am curious about is whether or not I could relocate and recieve medical marijuana? There are no special conditions of my probation. Any pointers or advice would be greatly appreciated. I do have qualifying conditions, and I would like to know if this is a lost cause.

  9. Sly- head for California! It's your best bet!

    Look, we have pot docs here who are nothing more than "whores"! They will just about give you a rec for being "warm and breathing"! Legal problems mean nothing to them- and they are usually the cheapest docs in town, so they are easy to find in any big city.

    We also have principled "Cannabis Specialists", who will be there for you if you end up in court and are reasonably reputable physicians.

  11. So even if I get a probation officer who doesn't whole heatedly believe in the Medical Marijuana movement, but the attending physicians beleived I would benifit, you think I would be able to go to court successfully?
     
  12. so ok how about this.. if a person has no drug felonys but.. has 3 other felonys for nothing drug related can u still get a care giver card even if u been to prison before and is not on parole or nothing but has had 3 felonys but no drug felonys or growing felonys or gun felonys.. just bullshit felonys
     
  13. I got caught for distribution like for friend and had a felony which is now expunged. I have my medical card. All in California.
