Legal marijuana use and work place drug testing

  1. It's an issue that I believe needs a solution soon, marijuana stays in the system for an exceptional amount of time, but if I smoked last night that does mean I'm high on the job this morning.

    I guess my question to the world is. Does anyone know if there coming up with something that will pin point actual impairment of a person at that specific time?
     
  2. There are no consistently reliable methods of retrograde extrapolation with THC and its metabolites like there are to determine when alcohol was consumed.


    That being said, being legal does not mean that an employer has to keep an employee who is using marijuana even under a prescription. The law that WOULD ordinarily apply in such a situation is the ADA (presuming this is in the USA) but the feds are not wholly on-board with medical marijuana and thus, you could reasonably expect that a federal court is not going to run with an argument that you had ADA protection for off-hours usage.

     
  3. The typical urine test is monitoring for breakdown metabolites of THC which remain within your system, not the THC itself. So the drug test only determines that you consumed cannabis sometime in the past, not how high you are at the moment. Tests which determine the amount of active THC in your system are being developed. Some use strips which are used to sample saliva. Of course, since regular smokers develop a tolerance to THC this still doesn't show actual impairment. But a blood count number will be chosen as the cut off point for legal impairment, just as is done for alcohol. And we've all heard a drunk tell about how well they can hold their liquor.
