Can I get a medical card in michigan for anxiety if Im on probation?

    Ok so I got pulled over with 0.5 of a gram of weed in Ann Arbor, MI and usually you would just get a ticket and pay it and be ok but since it was on the U of M property I had to go to court and now I'm on probation for 6 months. So my lawyer told me if i get a medical card it will protect me from anything in the future but I just met my probation officer today and he said that i can't smoke for 6 months and not to get a card even though the lawyer told me it would be a good idea. I'm actually a hypochondriac and have had really bad anxiety since i was a kid and I thought i just worried a lot but went to a doctor last year and he diagnosed me with anxiety and slight depression. I actually was jobless for 3 months because of my anxiety but anyways I was given paroxetine and about 4 other pills to take a day a couple times a day (like 12 pills a day) by my doctor and it was making the anxiety worse and made me lose my appetite and thats not good because I'm also a diabetic and have to eat six small meals a day or my blood sugar will go too low and i could pass out and i dont think taking that much pills is healthy so i smoke weed for my anxiety and it helps take my mind off of thinking there is something wrong with me all the time and keeps me in a positive mood all the time. Now i didnt tell my probation officer all that because frankly i was too embarrassed and also there were interns in our meeting and i didn't want everyone knowing my business so do you think i would be able to get a medical card in this situation and smoke while on probation? because my anxiety is starting to come back and i honestly dont feel like taking all those pills again.

    I read the Michigan law. You will be free from prosecution and penalty if you follow the law as your lawyer says in the FUTURE. You have already been prosecuted, convicted and are ALREADY in the penalty phase. If you break the terms of your probation you simply do whatever the judge had as an alternative such as jail time. A MMJ card does not wave a magical wand and get rid of convictions.



    To make it clear, get rid of all the bullshit about how bad it is for you to not be able to use MJ and here is why:


    IF IT WAS THAT IMPORTANT YOU SHOULD HAVE GOTTEN A CARD IN THE FIRST PLACE.


    You absolutely should get a card but wait until a month or so before your probation is up and do not smoke until you are in the clear. Why do it ahead of time? It takes several weeks in most states to get your card. There is absolutely no reason for you to have MJ on you in the future without a MMJ card in your pocket.

    The key to what your lawyer said was "in the future". The card won't do you any good in terms of passing drug test for probation unless state law allows people on probation to use medical marijuana.

    He can't revoke you for getting a card but if the po says no smoking for six months it is doubtful the card will help.
     
  4. I'm pretty sure you can't smoke weed while on probation, even if you had a card before getting busted. Otherwise there'd be no probation.
     
  5. Perhaps your lawyer can petition the Court (likely needs to be the sentencing Judge), to allow a Medical exemption to the terms of probate?

  6. Just don't smoke dude. It's 6 months, that's nothing in the grand scheme of things. Don't make your situation more than it has to be. When you are on probation, you're a ward of the state. They can jail you for any violation of it. Don't smoke and 6 months will be here soon.
