Can I get a medical cannabis card in my situation?

  1. Alright, so my situation is kind of unique. I live in Michigan and I do not have a cannabis card, I got caught with some marijuana and had to go to court. It was my first offense, also the county i'm in is decriminalized. So my lawyer got me a deal which is as follows: I'm under deferred probation, which means that there is no drug testing, it won't show up on any databases, basically nothing happens. I just can't get caught doing anything illegal until September. 

    Now my question is, can I get a medical cannabis card while in this situation? There is no drug testing, so I wouldn't be breaking my probation- it would just be me legally medicating. If anyone has any insight into if this would be alright (I mean I think it'd be fine I just wanted to hear what others have to say) please let me know!

  2. IF you have a qualifying condition, then I would ask your lawyer if you could get doctor approval for medical marijuana while on probation. I'm not familiar with Michigan's MMJ laws, so I'd advise you to ask your lawyer and if he says no, then just wait for your probation to expire and go into your doctor.
     
    I'm not sure why you're asking a forum full of stoners when you already have a lawyer who can answer everything for you. 
     
  3. LOL.. So true. I wouldn't ask legal advice on this forum.. I have two answers for you - 1) go get your card and if you get arrested, then you know that you shouldn't have. 2) Smoke Up Johnny.. if you get because you were breaking the law, then maybe you shouldn't have been breaking the law.

    Oh by the way, I'm very medicated. I'm surprised I can type. It took about a half an hour to write this response.. My finger tips hurt because Ii had to hit the backspace button a thousand times.. :D

  6. Michigan law.. I'm in Ohio so I'm somewhat familiar. Am I mistaken in you are one of the state's where rather than just a doctor referal, you can apply directly to the agency that controls medical cards if you have been diagnosed with a chronic condition (been seen multiple times for the same problem)?

    If so, I would apply directly to the department that issues them, then speak to your lawyer. I doubt your legal situation would affect you getting your card, but the matter of using it while you're on probation is where your lawyer would come in.

    If Michigan does have that department and you have a chronic condition, get the card ASAP. Just in case.

  7. Because of the situation, don't go trying to find a doctor just to get a card. If you don't already have something on record, don't try it. Everyone will look at it differently if you apply after this mess when you already had a condition than if you didn't until all the sudden.
