How do states operate in contrast to Federal law? 2nd Amendment

    What gives states the right to pass unconstitutional laws? Such as California? How do states pass laws that violate the second amendment?

     
  2. The 10th Amendment gives states sovereignty to pass their own laws.  Article 3 of the constitution establishes the "judicial power" of the U.S. 
     
    State laws can be challenged through the appellate court system.  If there's no resolution, it could eventually reach the Supreme Court.
     
    The 9th Circuit Court of Appeals has already ruled that California's concealed weapon law is unconstitutional.

  3. Well they don't because if they violate the second amendment they get rejected by the supreme court.

    Instead we grasp onto MTV and Facebook and just hope Uncle Sam is doing the right thing.

  5. How do states have medical marijuana? They feel that federal government is wrong and that there state needs these policies so they ignore them.

    It requires a lawsuit usually to challenge laws that are unconstitutional...well the ones that whatever side views as that. So if you are not willing to go the distance and spend the cash the law stays on the books.
     
    A good example is California has a law that requires rifles now to not be able to be ejected without a tool. So you can't quickly reload a new magazine. Mind you there is a device you can buy out of state or on the internet that goes on it to return functionality of that feature on your rifle but the anti gun crowd cheered, cried, and hugged when they got that passed and that is all that matters.
     
    The other joke of a law is limiting rounds in a magazine to 10. I am sure many on here are huffing and puffing but to the idiot anti gunite all that is is a block of plastic they put in a magazine to make it comply. About 2 mins of your time and the block is removed. Yet again though they cried, hugged, and cheered that the world was made safer when the idiots who passed and supported that obviously never took a magazine apart. When I lived in California I took my existing 30 round magazines and adapted them for that state when I went to the range.
     
    One might ask how they can do that. The NRA decided NOT to challenge that as if they did it could result in all 50 states adopting that so its best to let the nut jobs out in California live in there day dream.
     
    There are tons of laws everywhere State and Federal that never go unchallenged that would be removed if people or organizations took up the cause...just not enough money to do it.

    Very much how prohibition ended actually. People think it was just all of a sudden repealed. States started ignoring Federal Law and the Feds eventually followed suit.
