Medical Marijuana Law...

  1. So this is the story, I am from Michigan and I am a licensed medical marijuana patient & I borrowed my buddies bag to transport some smoking utensils. When I returned it to him I had apparently forgotten to take my grinder out of the bag. He went to the lake and was camping "illegally" which apparently constituted the search, for some reason...Idk, don't ask me. But anyways, they found the grinder in the bag. There was nothing in it (they did however do a swab test and it came back positive for Marijuana) and there was no Marijuana in his possession. I have offered to perhaps go to court on his behalf to claim the grinder as mine. but am I just cutting both our necks in this situation? Am I going to go in the court room and claim my property or is the Judge going to bring me up on charges, revoke my card and hold me accountable for an honest mistake?
     
    Any help and clarification here is deeply appreciated.

    how much trouble is your friend in?

    Better him for a few months than you fir a few years?

  3. Talk to a lawyer before you do anything....but I would think if you're legal for MMJ taking the responsibility for the grinder would be the thing to do....

    Here in nevada we are a medical state AND weed is decriminalized.

    BUT paraphernalia is still a felony charge.

    Lawyers and cops love technicalities.

    If your story happened in nevada, you could end up with a double felony charge even though your a mmj patient AND its decriminalized.

    You'd be a dealer for giving him the gridner, and be in felony possession of paraphernalia.

    2 strikes right there. 1 more is 25-life

  7. these are direct excerpts from Nevada state code

    "453.560  Unless a greater penalty is provided in NRS 212.160, a person who delivers or sells, possesses with the intent to deliver or sell, or manufactures with the intent to deliver or sell any drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, prepare, test, analyze, pack, repack, store, contain, conceal, [inject,] ingest, inhale or otherwise introduce into the human body a controlled substance in violation of this chapter is guilty of a category E felony and shall be punished as provided in NRS 193.130."

    "(b) A category E felony, except as otherwise provided in this paragraph, the court shall suspend the execution of the sentence imposed and grant probation to the person. The court may, as it deems advisable, decide not to suspend the execution of the sentence imposed and grant probation to the person..."


    So unless you're a habitual offender, odds are you will get probation, which in the realm of things is a slap on the wrist.

    Granted this says nothing about being a legal posessor of a MMJ card.
     
  8. Depends on where he was. If he was in a state or federal park your card wouldn't make a difference as you aren't legally allowed to use or possess in those places in addition to a few other places (schools, public transportation,etc) so there's that to consider.

  11. Thank you all of you for your responses. I didn't give him the grinder and it is also not about buying a new one. It's about the morality of the situation. I don't have the money for a lawyer. I'm just leaning on the fence here. Our friendship is strong, but not strong enough for me to lose my job over.
     
  12. You can still seek legal advice ffrom a lawyer without paying a shit ton of money.

    If you can afford weed you can afford a legal.consultation

    I'm not.making any assumptions. I have a hard time believeing any American cannot afford legal consultation.

    You MUST have something you can sacrifice for a few days to save up money.

    Trust me I known. My wife is the sole earner of our family and is in a dead end job at pets mart. We raise a child and.my.money is literally about 80% daycare and the rest goes to food and gas.

    And yet I'm getting a ps4 next week.

  17. I did, I called some specifically for medical cannabis related issues. They seemed less than helpful for free.
