Legal Questions About Wax And Scales

  1. Hi I recently got my MMJ recomendation and ID card from my doctor in California. I do not have the state issued ID card. Im pretty new to this and I have a few legal questions that Google could not provide adequate answers to.
     
    My first is this: Can you be charged and convicted of possession with intent if you are arrested with MMJ and a scale for dosing, but nothing else that would imply sales (such as cash and baggies)
     
    2) How much concentrates (specifically BHO) can you legally carry on your person?
     
    3) The state issued ID card is supposedly an extra measure of protection against arrest. Has any one with a State-issued ID card had any experience with Law Enforcement to verify this?

     
  2. Ok, first, welcome to MMJ in CA! 
     
    1. If the cop wants to be a dick, yes, but they usually don't bother. The law gives you the right to argue medical necessity in court, not exactly to carry it. Now, most cops will listen to you say you're dosing, and take into account the fact that you don't have other things, so I wouldn't worry. Plus, most cops just aren't bothering, as it's a big time waster, to arrest people for cannabis.
     
    2. There isn't an exact weight that is legal. You're allowed to have up to a half pound of cannabis, and there is no distinction between wax, flower, or edibles. Use your best judgement. 
     
    3. The state ID card is NOT necessary, but, technically speaking, it is the only card that law enforcement is BOUND to honor. Most cops just want you to have ANY paperwork, so don't feel like you gotta go drop another couple hundred for it, but..technically speaking on a legal question, that's your answer. Most people I know who have them, are very legally and politically active, so they are more likely to have run ins, and that is why they carry them, as extra protection.  It does, however, also mean you're in a state registry, which would be a reason some don't get them.  
     
    The way the law is actually written, you don't even need the paper, just a doctor to recommend it to you, but...practicalities and all, gotta be able to prove it lol
