Privacy/recordkeeping Policy/regulation Of Dispensaries Customers

  1. Hi(gh),
    Trying this post here, since it got no replies in the other MMJ forum.
    \nI am curious what recordkeeping policies and/or regulation dispensaries may have.  Specifically, are there any dispensaries where if one were to go in with their valid doctor's recommendation and pay cash, the dispensary would not retain any record of any transaction with the customer that could be used to identify such customer (other than an anonymous receipt/sales transaction).  I'm asking because I don't know enough about this as to whether there are any state regulations/rules requiring such recordkeeping, or if this is a business-by-business policy where some do and some don't maintain records.
    \nI know that people say HIPPAA keep patients' records are confidential, and that is all well and great if that works for you, but that alone isn't good enough security for me.  For one, HIPPAA is a Federal law and cannabis is still considered an illegal drug under Federal law.  For that and other reasons, the only thing that would satisfy my concern is not having any paper trail.
    \nJust curious on thoughts/experience here, I am obviously not a MMJ patient although I am prescribed meds for anxiety issues, so I know I legitimately qualify.  I feel generally ok with records my doctor might have on me in prescribing mmj, but I don't have the same confidence in a dispensary with such records, considering dispensaries are subject to Federal law enforcement raids and the law seems a little unsettled.  I am a California resident, if that makes any difference (e.g., maybe CA has more lenient or strict rules in this regard)?

  2. Interesting question! I'm kind of interested myself. I am curious to know, what would happen to you if the feds found your info and point of purchase sales?
     
      You may think I am a bit ludacris, but I told my delivery service to take note on me that "I want the highest THC available in flower". And they can keep that on record. Since i purchase nickle and dime quanities (see my pickup thread below), I don't think the feds will be too concerned about me.
     
      There are growers with like 10 oleander sized plants in their backyard. I think the feds are more concerned about that than anything else.
     
  3. Dispensaries are required to keep all records of sales in any legal state. If you are that paranoid, stay out of legal dispensaries and stick to the black market.

  4. Don't worry. They don't care about us. We are to small. I have 3 neighbors that run 99 plant grows. They don't even care about them.

Danko707 is probably right, I doubt the Feds would go after a customer, purely on a cost-analysis/resource basis---there is no value to them to do so.  My concern more is what were to happen if those records were "lost" after a Fed raid, and somehow your name ended up on a database or made public in some way such that your name came up on a background check...or someone got a hold of it and used it for blackmail purposes.  Not very likely, but not impossible.
