Gun Laws And Medical Marijuana - Nevada

  1.  So today I learned that having a Medical Marijuana license in any state will prohibit you from legally buying a gun. My second Amendment rights are somehow given up because I choose to obtain Medical Marijuana. 
     
     I live in the state of Nevada. Nevada has awesome gun laws that I cannot take advantage of because of the un-awesome Medical Marijuana laws. I have purchased or transferred 3 guns here legally before the mmj license and now I cannot buy my dream .45 handgun.
     
     My second Amendment rights have been violated, I feel. I like to shoot at the range and Id like to protect myself from home invasions.  I feel like I am being trapped into a system of people who cannot own guns. They can come find me and take my weeds or gun. I cannot have both because it somehow make me look like "Scarface"??
     
    Anybody else have the same problem? 
     
    I just started the appeals process and I am wondering if in the end the state will talk to the feds and approve me. Which is far fetched but I hope.

    Yes, which is one of a few reasons why I opted to keep my gun rights. A possession charge is much more minor then Illegally possessing a firearm. Is it ideal? Nope, can change though. life isn't fair, but you research the laws and figure out how to best go about your life, in my life the pros and cons of MMJ make no sense. Also the chances if being tied to a crime or even murder from a bag bought on the black market is non existent, buying guns from the black market.... Is not a situation I will willingly put myself in.

    Firearms purchases involve paperwork to the Feds, the Feds don't recognize MMJ even if they quit raiding dispensaries that are running on the up and up so MMJ clashing with firearms isn't surprising.

  3. Looks like I'll forever be buying weed illegally. They should do this with alcohol not marijuana. You'd think that people in the government are smart but they sound pretty fuckin retarded and illogical to me.

    Nevada should be easy to convince...it shot down the metabolite test as evidence of impairment issue...best of luck to ya  :smoking:
     
  5. Nevada shot down the metabolite portion as under a legalized system, many would be testing positive. When they start selling CBD pharma meds for billions in windfall profits, they can't have the masses afraid to take their pills and get behind the wheel. They are looking to the progressive future with such moves.
     
  6. Update. You can still buy a gun with a medical card just you cannot fire one while your are high. The questionnaire for the gun transfer ask If you are addicted to marijuana and you just have to answer no. 
     
    My case is different because of a mmj legal matter that is getting cleared up. 
     
  7. So. I am finding this stuff as I go along through the process.
     
    Today I went to the gun store to find out if I would ever be able to pick up my gun and I was told what I originally wrote. If you have a medical marijuana card you relinquish your gun rights. You cannot possess a gun while you possess a medical marijuana card in any state. I am being told that a federal officer can have a talk with you if you currently own a gun and have a medical marijuana card. For me to own a gun I would have to surrender my card and wait a year until I can apply again.

    i said before you are WRONG...Oregon lets patients have guns(and concealed carry permits)...move...
     
  9. He is correct. I live in ca and have purchased over 10 guns while being a mmj patient. I also have my conceal carry and had no issue getting one. It's the local sheriff that gives you yor ccw. Not the federal goverment.

    You guys have it easy there mainly because you cannot purchase Assault rifles and 50cal snipers freely. I can still buy shotguns and assault rifles off the internet and gun shows but not from the gun stores. 
     
    If I own a gun & when the police task force comes back to check up on me & that gun is confiscated than I will be facing some other kind of charges I dont know about. If the feds wanted to they could come seize your guns while the united states is still operating in this grey area of some people can and some people cant. 
     
    Here the gun stores and local classes give the ccw's. Thats not what I was talking about. If you owned your guns and licenses before you had your mmj card than that is what is probably allowing you to buy your guns currently. If you go through a background check again you may fail it; If you don't buy a gun through a private party you may fail it. I am searching the internet now for a shotgun because I need something for the house.

  12. I didn't own a weapon till I had my card. Never failed 10 background checks. I am also a farmer that has the sheriff come by every season to make sure I am compliant. He has not had an
    Issue with my guns becuse they are in my safe.
     
  13. I've only ever heard of issues with loaded guns associated with marijuana/grows. As danko said, keep your shit unloaded/locked up and you shouldn't have any issues...

  16. the fact that your calling them assualt rifles and think you can some how bypass local laws by "buying them off the internet" which still needs to go through an ffl and is subject to local laws tells me youve probably never purchased a firearm online before

    biometrics are great for the fast entree systems...set a few up back in my IT days.
    small safes with bio locks are pretty cheap these days too...well worth it.
     
  18. Wait you guys follow the laws?  They will have to take my guns and weed from my cold dead fingers.  Your government has waged war against you, fuck if I do what they say.  Just fly under every ones radar.  Get busted for something heavy?  Post bail, and skip town.  Fuck the system.
     
    @ srgtstadanco I didn't realize you guys can have ccw in cali.  That's sweet because you guys do have some of the shitiest gun laws.  always ways around that though.

    I did all my homework/research on gun ownership prior to obtaining my medical card and I planned on still owning a gun and possibly CCWing with my red card. Just because the federal government tells me "I can't" doesn't mean they can actually enforce that on me. Since I will be starting my grow this week though, when I do purchase another firearm I will be keeping it locked up for this very reason.
