Getting a possession charge in one state when you live in a state where its legal.

  1. If someone receives a possession charge in a state where possessing any amount of weed or any type of paraphernalia is illegal, but they live in a state where recreational use is legal, how does that situation get handled in terms of legal punishment? I mean, could a probation officer do random drug tests on someone who lives in Washington or Colorado where it is legal for recreational use?Or could someone who holds a medical marijuana card get randomly drug tested because of their charge in the other state?

  5. I doubt they will refuse to let you live in your state while on probation for such a minor charge and if you are in a different state it would be quite difficult to drug test you.

    If you are going to be staying in the state where the charge is and are hoping that the out of state license will save you.. I suspect the guy you quoted is right.

  8. I'm not sure but I assume they will continue to charge you with whatever they can.
     
    Just like if you get in trouble as a minor but don't deal with it until your an adult, your parents still has to goto court...
     
    What I'm trying to say is the charges won't drop just because you're in a diff. state.

  10. You will still be accounted for that charge its up to the judge to decide if its a hassle to put you on probation or not 
     
  11. well, the state where you "broke the law," is going to insist on penalizing you for it, which has nothing to do with where you reside.
     
    But the testing question is interesting. I would expect the least favorable outcome, and that they would indeed forbid you from recreational use, even in your home state where it's state-legal (but still federally illegal)... and probably even with a med card. The system has a funny way of always screwing people somehow. I suppose you could say that's kinda the whole point of having a system in the first place.
