5 plants period, if you have a mother and cut 4 clones and out them in the dirt thats considered 5 plants because it's 5 individual grows. Hope that answers everything.
...and you know that how, seeing the OP didn't list the state he's in?

It's the same everywhere. If the clones are not in soil they aren't considered a plant until they've grown to the point of splitting into 2 stems r however you describe that.

Kentucky (learned that from Pearl the other day)I think its Ohio. The only state i know that gives a misdemeanor for growing.

In most states with MM you will note....you can not be prosecuted for ANY Marijuana offense...SO GROW ALL YOU WANT..All they can do is take away the exter plants..My buddy got busted with over 400 plants and they did NOTHING but take the exter plants away..These MM laws are written so bad that any lawyer could drive a truck threw them, and the state knows it. Thats why they cant do any thing...WE HAVE WON!Thats really hard to stay under 5 doing any kind of perpetual grow. Oh well, I'll figure it out. I recently had my first child and want to make sure Im at least in the misdemeaner category.

They do what swat does when they raid a home or dispensary, they weigh the whole plant, with pot, dirt and all. A pot full of dirt will measure up to 50lbs real quick, too.I would definitely go with 5 bigger plants instead of perpetual in your case. Massachusetts, where I live seems the laws are vague about cultivating. It's a misdemeanor if you grow under 50 lbs. Above that is a felony charge. What they weigh to find out the actual weight of your grow, however, I don't know.

Think of this scenario; you're growing two plants, there's hardly any bud on them at all, you just watered them, and then swat breaks in and busts you. Your total weight is 80lbs, but 30 lbs of that is water. Yeah, you just got screwed hard!So feeding my plants might push me over the limit. Ridiculous.

so true, my old dealer got busted for having 4 plants. they settled on charging her with 65 pounds of weed when the plants were all 6-8 inches tall. shes still locked up D:<
