Caught, charged with unlawful posession

I've been pushing my luck in recent weeks and have had a couple run ins with authorities with trespassing and whatnot, and last night I finally got caught.

I was at a grad party where the majority of my high school class who just graduated were all attending. One of my good buddies got sick so I walked him to the mini-van, pulled out the seats, and threw down some blankets and stuff for him so he could pass out and sleep it off.

The mini-van was parked about a 5 min walk away from the party in the parking lot of a high school and the cops showed up. My friend was nearly unconscious in the car, and I was pretty drunk/high, maybe 8 drinks and 2 joints high or so.

I had my grinder, one joint in a prescription pill bottle, my glass pipe, and less than 5 grams of weed.

The cops brought my friend and I back to the station and we had a rough night. They tried interrogating us about the party we were at but we didn't say anything about the party. They eventually called our parents who had to drive about an hour and a half to come pick us up.

My friend got off with nothing, I have a court date for "unlawful possession of marijuana." This all happened in New York state and I checked Norml and I think I'll have a $100 fine because its my first penalty. I live in CT.

Yea get a defender or lawyer they might not go easy on you hard to say. Explain to your PD or Lawyer the ENTIRE situation tjough

In NYS if you've never had anything before you will probably get the UPM dropped to a lower charge. I forget exactly what they call it, but basically you do some community service and go to some substance abuse programs and then it is completely wiped off your record forever. Basically, in the end you're going to lose some money going through all this but you'll probably be able to get this lowered and then off your record

I saw the cop car across the parking lot driving towards us so I tried to hide the weed stuff in the car under my friend's blankets as fast as I could. The cop came over and shined his flashlight in my face and forced my friend to lift up the blankets. My buddy lifted the blanket and the pill bottle rolled out of the car onto the ground at the cops feet. It was pretty fucked right from the start, didn't really have a chance to get my head together before the cops found the weed.

Well I had my court date earlier this month, they gave me a slap on the wrist! I need to stay out of trouble though, at least for one year, because if I get arrested again they will bring this 'unlawful possession of marijuana' charge back up and charge me with it along with whatever I get in trouble with next time. Thanks for the help/support, I didn't hire a lawyer, went in there all by myself and didn't lose a dime.

Nope it was really dumb in retrospect. The hosts of the party didn't want 30 cars parked on their street though so they had literally everyone park in the highschool parking lot.

Finally!! Some body asking questions about new york!!! Don't need a lawyer, it's just a fine! They probably gave you an appearance ticket! Go to court, the judge will ask you if you work and if you graduated/ attend school and then he will ask you if you require council which is a lawyer, say no and he will continue with the fine, the amount is up to him min or max wise.

The cops had any/every right to search you and the car for being on school grounds especially their parking lot.

Don't waste time and money on a lawyer, you're not going to jail or anything.

Many people are surprised to learn that unlawful possession of marijuana is not even a crime in New York State. Unlawful possession of marijuana is classified by our legislature as a violation. A violation is the legal equivalent of a traffic ticket.
