Question religion above law

I had to appear in court today, I saw a lady covered head to toe, in black garb, letting just enough room to be able to see. Im not sure exactly why, but I felt uncomfotable seeing her stand in the back of the courtroom by herself dressed like that. I felt as though she had something to hide, which from her religion views, may be so. Ive seen many people wrapped in garment before, but this time it stuck me uneasy.
I found out that in florida, a Muslim woman took to court and won, her case which allowed her to have her photo for her drivers license taken, covering her entire face. Religion won against this country's law.
I just wanted to know if anyone else has any opinion on this, if youve heard of the case, or anything of the such.

I've never heard anything as extreme as that before, but I do know that the right to exercise our own religion is strongly expressed in the first amendment of our Constitution. We allow Native Americans to use peyote in their churches that have been using it for spiritual purposes.

We allow quite a bit for religion, and I don't think that it's necessarily a bad thing. Just because we can't understand something, should we condemn it? This country's first settlers were largely those who were fleeing countries in which their form of religion, beliefs, or class statuses were considered "undesireable." The intent was to create a country in which you can perform your religious beliefs with little resistance from the government.

I do find it odd though, and maybe a bit disturbing that in these days of high security levels, a woman can take a drivers license picture with her face covered. I am also, in a "go 1st amendment!" sense, impressed that she was given that freedom. Religion didn't win against country's law, the law was written to respect all religions, but I can see where you're coming from.

A similar case was a big deal in the french media a while ago. I'm a little sketchy on the details but if i recall correctly a 13 year old girl wanted to wear her burqa to school but wasn't allowed to. She took the case to court and lost.

As for the case at hand I'm not quite sure if religion 'won' over authority as the ruling was undoubtedly based on a law that the lawmakers percieved as having priority. In this case why couldn't they find another distinguishing feature of the woman that wouldn't require her to uncover her face? Perhaps they could institute an alternative form of identification (something to do with fingerprints i'd say) for people who can't or won't have a driver's liscense picture taken.

I'll elaborate: The french constitution is based on a very important principle: The strict division between state and religion. A burqa (what sensi talked about, the full body coverage) or a scarf on the head (dunno the right term) are regarded religious symbols. Any of those are banned in school. Christian crosses and the star of David are, too. Not only in school, but in all state institutions.

In Germany, there's currently a similar case which, I think, is going to the supreme court now: An islamic teacher wanted to wear the scarf during classes, but got banned from school. Now this one is a bit more tricky, because (specially in catholic Bavaria) they got crosses on the wall in some classrooms, but the state religion is christianity. I think they settled on a temporary agreement now: Where there's a great part of muslim pupils, as in big cities, teachers are allowed to wear the scarf, so I guess religion temporarily won over the law

Btw...sensi...what were you in court for?

I was quite unhappy with that ruling. I followed much of that and was stunned at the outcome.

Some people just take koran waaay to seriously I'm not saying it's THAT bad or anything but I beleive it says "women must cover themselves" They just took it far to literally women at that time were walking around topless, it wasn't reffering to their whole damn body, I mean what is really the point behind hiding your face? If there is a valid reason please post it and relieve me of my ignorance.

Re: religion above law

the license picture:
this is uterly ridicule.
the picture is there for identification purpose. How can two eye identify anyone.
stupid. stupid stupid.
that rulling is uterly stupid. What if my religion asks me to kill a dog every time I pray? will I be allowed to do so?

+++

as for the french rulling.
It's a little more complicated then that it seems from foreinger's point of vue.

The girl's familiy were being manipulated in an attempt to discredit France's tolerant system.
She did not want to wear the thingybob for a religious matter, but for a political matter. Our justice system made sure politics would not go into schools.
end of story, whatever you hear about it.

lately (americans propaganda?) there has been quite a lot of propaganda about France VS mulsims, so let me put the reccord straight as I am french and i actually know: French governement, and the majority of french population do not have any problem with ANY religion, as long as the practice of that religion does not intefere with our consittuttion.
I have heard from foreign news chanels that france is not tolerant, and wants to kick out muslims.
well there may be a few french idiots whom might think that, but they do not represent anything worth mentioning. Every country has a few idiots in its population.
