I have a somewhat similar story to counter the bold statement. It was in college on a blunt ride.

We went somewhere away from campus to pick up (dry), but it was pretty distant from the college. So we figured we'd roll up a blunt for the ride back. Anyway on our way back (maybe about 10 mins from campus) we just finished the blunt and my boy had to piss real bad. So we pulled over beside the road. A cop happened to be passing by why he was pissing (our luck of course) and immediately pulled over.

As soon as he got near my car he claimed he smelled weed in my car, and of course he did, it was right after we smoked. Now even though we just finished the blunt, there was still another two bags in the glove compartment. He then proceeded to ask me if I could search my car, I said no. He asked me to step outside. I stepped outside, but first, I rolled up my windows, took my key out of the ignition (held in hand), locked and shut my doors behind me (left my friends inside, only I was asked to step out).

Once I stepped out, he immediately knew I understood my rights. He was basically trying to entrap me the whole time, because that's what cops do. They try to make you unsure of yourself. Asking the same repetitive questions to see if you change your story, by using intimidation (or force).

He knew it smelled like weed, but he couldn't search the car because I said no (and because I followed all the preventive steps above) So he said, we're going to call the K9 Unit. This was obviously intimidation being used, because it was like 2 am; they ain't calling in jack shit. I knew better, I said, "if you do, you're not going to find anything and it will end up being a complete waste of time for you an your colleagues." He ended up calling backup, but he attempted to make me believe it was the K9 unit coming (so he could keep playing mind games with me to see if I would crack) and the game continued for like an hour. After reasoning with them both, I had them believing I boxed out the car a few days ago and it just lingers for a while (They seemed to understand this lol). After that he talked to all my friends separately outside the car, and they all stuck to the same story. I smoke, but it not right then and there. One of my friends even said, "I haven't even smoked in a week."

A few of us had cigs lit, so luckily they cops were also unsure of themselves. Remember, it's a game of wits, not who can think the best story up, but who can last the longest with that story; endurance. Stick with the same story, and you will come out on top. Ours was, we went to visit a friend off campus, that's all they need to know. The more you add to the story, the more they know, but the less they know. The better off you are. Keep it simple.

I knew I was golden because there wasn't anything in that car, other than the bags in the compartment. Not a single piece of bud, ash, stem or Dutchmaster guts because I just cleaned it a day ago (lmao). When we used to go on rides, me and all my friends would use eye drops (Rhoto V) so they would always look like glass, so clear it would look like we never smoked weed in our life. You have to act, make the cops feel like they're doing something wrong, because since you can't beat them your only chance of survival is to use their methods to your advantage.

Again, these are exception to the rules because it was a perfect scenario (but by being cautious, you can always make it perfect scenario for yourself, god for bid a cop pulls you over when you have Cannabis on you).

Remember what I said before, it's just like a void or a cipher when it's in your compartment (especially when you see it that way, because you act like it's not even there).
Wrong.. If he smelled the weed then that alone is probable cause for a search.. your consent would not be needed.

Don't really hide anymore ( moved out on my own) Usually just on the coffee table in my bedroom.

But when I lived with my rents I hid it in an empty printer.

Re: •••Where Do You Hide Your $tash•••

Dunno how it works where you all live, but around here they'll try to pin anything they can on you... we were somewhere, got caught, they found 1 beer botle in the grass, no beer bottles in our cars or anything and they said it was full and had condensation on it so we must have been about to drink in public and hid it from them. We weren't so we denied it, when they left it turns out th bottle was empty with no condensation and he was being an asshole. Plus they don't have to smell it if they "smell it". They can just say they do or whatever. Or at least that's how it works around here. Sure, it's probably illegal for them to do that and search your vehicle on the basis of a smell they made up, but I'm not about to go down to the cop shop and argue it - cops stick together on that stuff.

NO, YOU'RE COMPLETELY WRONG trust me on this one, as it happened to me personally (more than once, that was just one time). If he happened to ILLEGALLY search my car (as you state above), when it came time to open the glove compartment. He would not have the right to open it without a warrant; end of discussion.

Great website though, lots of information on it.

I got +rep though by ONE DUDE IN PARTICULAR WHO ACTUALLY JUST GOT SAVED FROM LOCKING IT IN HIS GLOVE COMPARTMENT, RIGHT AFTER HE SAW MY POST.

Either, i misunderstood you or you misunderstood me. Im not saying that he would, or wouldn't find the stash in your glove box. Im saying that if he smelled the weed then he would not need any consent to search your vehicle. Going on this you're wrong.

Re: •••Where Do You Hide Your $tash•••

As to the locked glove box not being able to be searched, there is a lot of case law that you can go through that is very specific to the situation and the State. Here is an excerpt from a police policy manual that clearly states a locked glove box CAN be searched if probable cause is found:

Quote:
9-206 VEHICLE SEARCHES
(B-C)
Vehicles may be searched without a warrant in the following circumstances:
1. With proper consent. See Volume 9, the section on Consent Searches for more details.
2. Probable cause exists to believe that the vehicle contains the fruits, instrumentalities or evidence of a crime or contraband. In such cases, the officer may search all areas of the car they have probable cause to believe contain the item being sought. The search must be limited to the areas where the item being sought could reasonably be located. For example, officers cannot search the glove box if they are searching for a large screen TV set. Also, once the item being sought is located, no further search is justified.
An officer may open the trunk, glovebox and all containers, including closed and locked containers, even if it requires breaking open the lock. Where search of a closed and/orlocked container would require damaging the integrity of the container, the officer shall balance the need to search with the cost and amount of damage to be caused, and shall consider other alternatives such as trying to obtain a key and the ability to seize the container and later obtain a search warrant.
3. When an officer stops an occupant of a vehicle and has reasonable suspicion to believe that he/she has been involved in criminal activity and may be armed and dangerous. The occupant may be patted down for weapons and portions of the vehicle where a weapon might be readily accessible may be searched including unlocked containers (i.e. the glovebox).
4. When an officer makes a custodial arrest of an occupant of a motor vehicle, a search incident to that arrest may be made of both the arrested occupant as well as the entire passenger compartment of the motor vehicle. Any clothing, unlocked containers and unlocked glove boxes can be searched. The trunk cannot be searched.
5. When an officer takes the owner and/or driver of a motor vehicle into custody and makes the determination to impound the vehicle. The officer shall conduct an inventory of the contents of the vehicle.
6. When a vehicle is unoccupied and towed by police order (white tag tow). The officer shall conduct an inventory of the contents of the vehicle.
The inventory required for situations 5 and 6 shall be for the entire vehicle, including the glove compartment and trunk, if they can be accessed without damage to the vehicle. All containers shall be searched if they can be opened without damage. If a container cannot be searched without damage, a determination of the value of the property in the container shall be made if possible (such as by talking to the owner). All items of value shall be listed on the tow sheet. Where possible, the officer shall remove and property inventory any items of significant value for safekeeping. The officer will indicate on the tow sheet what items were removed and inventoried and what items were left in the vehicle.
When a vehicle to be searched or inventoried is towed to another location because existing conditions make it unsafe or impractical to search or inventory the vehicle at the original site, the authority to search or inventory the vehicle still exists.
However, in the case of probable cause searches (item #2 above), the practicality of obtaining a search warrant prior to the search shall be considered.

If an officer is conducting an illegal search, (no probable cause, no consent) then anything they find no matter the location, (provided it does not fall under the "plain sight" stipulation) would not be admissible evidence.

The main things to keep in mind:
1) Do not provide probable cause in the first place (don't drive stoned, don't leave shit in plain view that the leo could see upon looking into the vehicle.)
2) Do NOT give up your rights and consent to a search.
3) This gets sketchy, but even the TIME OF DAY that you are in an area can be considered probable cause.

*** I am not a lawyer, but a minimal amount of searching and reading will give you this information. In the instances of people not getting arrested that you cited, the individuals were LUCKY, not good.

I heard they can't search safes in your car without a warrant, too, is this correct?
