i got suspended for 10 days and recommended for alternative school
not for bringing cigarettes to school
or alcohol
or weed
or pills
.....

they took a picture of my screen while i was on GrassCity and i was messaging someone about what the bud in their area was like
they originally charged me of internet usage violation and profanity (oops) which they gave me 3 days suspension but the superintendent and the principal increased it to the 10 days and alternative school....my parents are freaking out, i may not be able to get a lifeguarding job i applied for because, i am uncertain how my college will take a stain on my record like this....i am at the end of my rope
does anyone know if I have some sort of defense
can they really punish me for content?!?!?!

You are always entitled to defending yourself. Don't let anyone ever tell you otherwise.

Whether or not that defense will result in changing the situation is up to how you approach it. If you have a lawyer handy, I would advise speaking it over with them.

With schools, it's really tricky, because the Constitution doesn't really apply to most schools. Once you walk through those doors, it's a different world. IMO, I would try analyzing the ruling, and seeing if there might be any specific wording on how content applies and if you being monitored infringes upon your rights. If there isn't, it would be a good place to start fighting. Realistically, schools are pretty closed minded, so I can only wish you the best of luck. Have you tried having a sit down talk with the super intendant or principal with your parents there?

I completely agree, this would probably be the best course of action with this.

First, I'm sure you don't want to hear it, but it needs to be said:

Bad idea coming to GC while logged on at school. You know they monitor all internet activity, and I'd be willing to bet that this isn't an approved site. Hell, I couldn't even go to a college basketball message board when I was in high school, so I'm pretty sure a marijuana-themed forum is probably out.

Here's the problem: The school has every right to monitor your use of the internet while you're using their computers and connection. It's also relevant that the school technically possesses the same authority over you that your parents do while you're in attendance. In other words, they have the right to watch what you're doing and to punish you even though they acquired their information in a way that would be objectionable to just about anyone outside of a school setting.

I'd emphasize the difference between visiting a message board about marijuana and bringing marijuana to school both to my parents and to the people who make the final decision about your punishment. It's probably a good idea to have a long talk with your parents first, though. If you're planning on contesting the ruling, you'll probably need them to come along.

Seriously, though, I think you got a raw deal. It wasn't smart to do what you did, but it's not as if you were in possession of something while on school property. It's also not as if you were encouraging others to behave in a manner that's contrary to the student code of conduct. I'm sure you've violated a regulation of some sort, but it sounds like the punishment they've chosen is excessive.

If you know of others who have been caught on websites where they shouldn't have been, talk to them about how they were punished. If you know others who have been in trouble for other, more serious offenses, talk to them to see if your punishment seems excessive.

As for the talk about a lawyer, that's up to you and your parents. I'd do my research before worrying about some sort of legal defense. After all, it's not as if you did absolutely nothing wrong.

In any case, hang in there, man, and explain what happened to your parents and why you think you're being treated unfairly. They can help you more than just about anyone right now.

Never ever take, talk about, or look at things in a school that can be questioned. Sadly it is their computers so they have a right to set whatever rules they want. I dont see fighting against it helping you any it may just make things worse.

my old high school was so desperate to bust kids for anything when i was there

one day i was leaving class and seen a classmate i havent seen for a while down at the agriculture garden so i went to say hi and talk story, well they were puffin on a joint behind the greenhouse where NOBODY could see them or me, they asked me if i wanted a hit but i turned the offer down because i was already baked as a muthafucka from my before school morning session

well a couple of classes later i get a call saying that i have to report to the principals office, so i go there wondering? "what the hell did i do? ...its all good kuz i know i didnt do anything wrong so lets just go there and see what the hell is up "

so i get there and they tell me they are suspending me for 90 DAYS because someone said i was smoking WEED by the greenhouse...well i started laughing because it all was bullshit and i told them i wasnt smoking and asked them if they had any proof besides an assholes word, i told them to search me and smell my breath (which was normal kuz i had breakfast after the morning session and this was a couple hours later) ...they refused to search me kuz they pretty much knew that if they didnt find anything that i would be free to leave, instead they WANTED to just assumed i was smoking and was guilty so i got kicked out of school for 90 days! fuckn BULLSHIT, i was trying really hard to get my credits and finish school and this is what i get? all im trying to say is i know where your coming from, my old school was really desperate on busting people for EVERYTHING THEY COULD, the only reason i didnt go to court and fight it was because i already been to court for a couple things and i changed since then and i didnt want to be in that environment or scene anymore as i was turning 18 pretty soon, and well because i think court here in hawaii is a huge waste of time and gas money, it takes them sometimes over a year to even get to your case and then u have to keep going back, i once had to go back and forth 6 times to resolve a case that was really childish and a waste of time

later on down the line we came to find out that the kid who ratted out only seen me and my friend (s) walking out from behind the greenhouse, he actually didnt see anybody smoking, he was just one of those kids GOODY GOOD DOOSH kids that are mad at the world and couldnt mind his own business

i bump into my old teachers now and then and believe it or not they even feel like school here is a bunch of unfair bullshit for the students, ive had teachers i know tell me that school nowdays isnt worth your time, they tell me that the system is so fuckd up its too far gone to revive and they have lost their love to teach, ive gotten reccomended by teacher to just leave school and get my GED because it was a waste of time to stay in there

these all came from really nice teachers that i never thought would ever say anything like that ever

just to let u know, once u turn 18 your record will be clean so dont worry about not getting into a college because of this bullshit, youll be fine, as for me, once my record was cleared there hasnt been anything put back on it and i plan to keep it that way

and i dont think they have the right to suspend u from school for simply looking at something on the compuer...???

Dude, I had sorta the same thing happen to me at my high school when I was like 16. They didn't even catch me on the site but they printed out the cache of my LiveJournal shit and called me into the office one day. A bunch of kids got in trouble for it cause some how a virus had gotten onto the school servers. I think it was just shitty protection on the schools part. They suspended my internet privilages for the remainder of the year.

but nah its cool we are appealing the recommendation for alternative school so hopefully something good will come of that
