No, bro, they don't. the only time they have to is when they want to question you.

When you pull someone over and find two bags of green on them, there aren't too many questions they need to ask.

In your crackhead buddy's case, they may have asked him questions that led to his indictment that weren't mirandized.

If you don't trust me, and why would you, I only passed the bar, feel free to call any defense attorney in the phonebook and ask him/her.

I had this conversation with my lawyer, too. They don't need to read you your rights when you are being charged. Only if being detained without charges pending. Like... you know, being questioned? ^^^^.


Also, for the person who asked about the traffic stop in Canada, while I don't live in Canada I did see an article somewhere on the internet saying that Canadian police can no longer search a car on the smell of marijuana alone.

To the guy who said he cant search me, trust me, when your being questioned theres nothing you can do whether you have rights or not because THEY WILL NOT LISTEN TO YOU. He did not ask to search my car, and even if he did I'd say no and that would give him even more reason to want to search it.

Agreed. Anytime anybody I know ever refused to consent to a search, the cops just called a K-9 unit. You have to wait till the K-9 unit comes...and if you claim its unlawful to hold you, theyll find some reason for holding you. They always do, even if its complete bullshit its your word vs. theirs... So i just cut up my car to create a perfect little holding space for weed, esail accessible but impossible to find if you dont know its there, so if i ever get pulled i'll happily comply to a search. Theyll never find it.

Get creative with it. If you want to have a good please to hide your stash be dedicated to it and make one. Theres a lot of free space in your car not taken up by anything.

theres usually a camera at the lights themselves to snap pictures of people running the lights.
find out if there was one there
and usually the camera is turned on when they pull you over.
but who knows maybe it was on the whole time.
bring it up in court.

That's a major bummer. I've been in your shoes before. I spent 8 days in jail when I got busted. It's a LONG time when you're locked up. You should definitly Lawer up. It sounds like you have some "holes" in the case against you. You will probably get it reduced from a Felony and end up getting sentenced to some "education" and a few years probation. You can PM me (but I see you're banned) if you have any questions about anything. I got caught with a lot more then you did and came out ok.

Sorry to hear that hoast. I'm from MN around the Minneapolis are and was in a similar felony sitiation. Except I had over a p and a half. Chances are, you wont get a court date for a LONG time, and you have to appear like 6 times. If it;s your first offense you will most likely get diversion, which is probation for three years. They wont charge you for the bud unless you get arrested for anything else within the three years
