This *IS* how it works so any debate can be ended. When the police arrest you, they don’t have to read you your rights. The police only need to read you your Miranda Rights if they want to question you. If the police do not read you your rights, then nothing you say can be used against you at trial if you are questioned.

This is some great advice guys.


Get a lawyer first. Challenge the traffic stop, if you drove through a yellow light under the speed limit and you were already over the line before it turned red, then you are in the clear. If that doesn't work, try and get the charges reduced.

Let us know how it goes.

Yup this is probably whats going to happen. It was like 1 am, NO cars around and I went through a yellow light didnt even see it turn red. He asked me why and I said I didnt see anyone around and figured I wouldnt slam on my breaks. After that he said step out of the car, searched me, arrested me.. and thats all I know.

I know how people say "oh police cant search you blah blah" well whatever even if he was doing something wrong I STILL HAVE TO COMPLY with whatever he says. If he starts searching me and I say "hey, you cant do that" you think hes gonna listen? No.

My question... Do police record video CONSTANTLY? Or is it only in pursuit? If so, I could claim that the traffic stop to begin with wasnt legit and go back and check the video if hes claiming I ran the light.

We got rolled on last night, it was scary first but the cops were chill as fuck. One lived near me (600 miles north). We were all joking and laughing and they just checked our backgrounds and shit. Our car was sooooo hotboxed too.

Anywho, I have a question pertaining to this thread. Say this guy goes to traffic court, and gets his yellow light dropped, would that excuse him from EVERYTHING else?

Yes! Because there is no such thing as running a yellow light so how could they drop it! Its perfectly legal, so basically he pulled me over and said "You were cuttin that light pretty close there how much ya have to drink tonight?"

If they find out that he had no reason to pull me over I'm pretty sure all charges will be dropped.. this is what I was told.

It still doesn't take away my $600 for bail, $200 to get truck out of impound and the 24 or so hours I spent in a dirty fuckin cell

Shit well who knows because about 100ft ft before the light there was 2 cops (lights flashing with a guy pulled over) so they were already on someone but let him go. When I went thru the light they must have seen it and thought I ran it so they pulled me over. One of their cameras might have been on. I hoooooope so.

idk, even If they broke the law arresting you, who cares?

Our whole government is already built around avoiding the constitution and using loopholes (Iraq, fed, DEA, IRS...)

It doesn't even matter what the law is anymore cause they just break it, but we're the criminals

I wish you all the luck tho seriously. My guess is they're gonna hold onto that traffic charge like its gold. You might as well get a team of traffic ticket lawyers and beat that ticket as opposed to ONE expensive-ass litigator

You have the RIGHT to deny any search to your own property, a CONSTITUTIONAL RIGHT, it says it right there in the bill of rights, amendment 4, look it up. If a cop searches you without probable cause or a warrant, they NEED your consent to search, otherwise it is an illegal search. Smell alone is usually not enough for probable cause, they'd probably need a canine unit to smell the outside of your car for that. You have to TELL them not to search though if they start searching without your permission first, don't allow yourself to be victimized. Learn the system and play the rules, they work in your favor.

Let this be a lesson learned.

You need to go down to the station and pay like $15 or whatever to get a copy of the traffic stop and arrest report. YOU do this, not your lawyer. It is way cheaper for you to go down and pay $15-20 than to have your lawyer do it and bill you $300 for his time.

If they wrote it up as a Yellow, then it was an invalid stop - charges dropped.

If they lie and say red, then you'll need to press on why they didn't cite you for the failure to yield (stop at the red).

They may have dash video. Some turn it on for every stop. You will need to ask what the dept's proceedure is, and then subpoena the tape. You can do this by calling your State Bar association and asking what the number of the legal form is for a subpoena. Again, way cheaper if you do it instead of your attorney. Some states have it all online.
