They cannot charge each of you with possession of 56 grams, they either have to stick it on one person, or charge you each for 28 grams. Once you are fighting a charge of 28 grams you can claim it as personal smoke and maybe nothing more than a misdemeanor + fine. Talk to a lawyer and don't fall victim to the law. It's gonna cost you some money but DO NOT plead guilty to a felony, see a lawyer.

generally, they wont charge you both for the weed unless some1 doesnt claim their part of the prize. when both parties deny its theirs, or say its the other persons, they charge both with the same crime. are you sure that your friend didnt try to sell you out and say all of it was urs?

Maybe not, maybe so. It's tough to say. Sitting here I'd like to say I'd be loyal enough to my bud to sit there with him if he can't get out but I don't know. I'm just glad I've never been in the situation of being in jail.

Obviously get a lawyer, they can work wonders with getting shit dropped to misdemeanors. My buddy got caught with 25+ LBS, in FL, and only got probation. First non-violent offense. He slipped, got caught with just as much weight again, and they recharged him.

I already feel pretty shitty for leavin' him in there, but I had seriously $600 in cash to my name and I needed 600 to bail out, and if I didn't do that I'd probably lose my job. My job is worth more than $600 to me.

It's a shitty place, its easy when your outside to talk hard and whatnot and say yeah i could kick it til then but I couldnt eat, sleep, think, everything was too fucked up.

The 56 grams can easily be argued. If you each claim a bag, then you have 1oz and no felony. You need to explain the scale as SOLEY being used for the purpose of fairly splitting the weed.

You also need to stick to the story that you both brought your own money and BOTH purchased the weed together - if you say one went in and then you split it, whoever bought it is guilty of distribution/sales.

They cannot pin the entire amount on one person if both claim it. Get an attny., argue it and plea down the count to a misD.

You may even be able to argue that the stop was unlawful (depending on what you did to that yellow light). If you successfully challenge the grounds for the initial stop - the rest gets pitched.

Yup, we had 2 oz in 2 separate bags. The scale they already threw out the window because we only got a Possession charge.

The reason we got pulled over, which I was just pulling my hair out over while sittin in my cell is I saw 2 cops with a guy pulled over and their lights flashing, so I passed em figuring good they're busy, but right as I pass them the guy leaves and the light im going thru is yellow turning red and one pulls me over.

Done. I dont think it was a fair call but there was nothing i could have done! right as he walked up to the window the skunk just hit him in the face. We hadnt even been smoking either not to mention.

yo dude, if the cops didnt read you your "miranda rights", which is the right to remain silent anything you say can and will be used against you in a court of law etc..., well if they do not say this then they are in violation of the constitution. and you should shove it in there faces and dismiss all charges. and unlawful search and seizure is a big right that we as americans have that has been infringed upon by the government, like has anyone seen that the government can prosecute a person based on text messaging. thats some bullmess im out

To the OP sounds like the cops are really tryin to fuck you two over, fighting the 56g thing would be very beneficial since in MN possesion of up to 42.5g is just a misdemeanor
