My dumb ass friend thought it would be a good idea to go to the park at 1 am to smoke instead of going to my house.

So we go into the basketball court to smoke, which is completely surrounded by a huge ass fence and only 1 door. Cop pulls up to the door and were fucked.

They were about to let us go untill they saw philly guts on the ground, then searched us and my friend got caught with the weed (which was about a half oz ). He went to jail, they told me to go home (which im suprised, i thought i had a warrant for not paying court fines from march), and my other friend got a citation for being out past curfew and possibly sent to juvie if nobody was home at his house. Havnt heard from him since.

Damn I hope my friend dosnt get in to much trouble.

the juvi that got busted won't be in alot of trouble if he isn't already on probation. the most he'll have to do is stay in juvi a night, and go to court in the morning. he'll probaly get put on probation for a few months. If he was on probation, he might have to stay for 28 days then get sent home on probation for a longer amount of time.

You have already messed up.
You should have known your rights.

Police can not search you unless they have a warrant, unless they arrest you. You could have fully refused a personal search, it is your right.

If you are even approached by police officers while high or carrying drugs, ask them if you are being arrested (officers are reluctant to arrest you without good cause). If you are not under arrest, tell them you are in a hurry and must be on your way, and then head directly home.

Please, know your rights and liberties in your province, state, municiplity, country, etc.

Also, if you are on government property (ie schools, or school playgrounds) police do not need a warrant or arrest to search you.

Knowing your rights and liberties is key to never falling into legal trouble.

Not unless there is a criminal investigation going on. Just because they found tobacco on the ground doesn't give them grounds to search you.

If they insist on questioning you, you should insist on having a lawyer present.

Now, i have never gotten to that point, but i am sure that 95% of cops will not wait an hour for a laywer to arrive.

Being polite and curteous will usually get you through it. Just tell them that you'll be on your way and there will be no trouble.

Rasta_Man Banned Join Date: Dec 2004 Posts: 11,223	You have already messed up. You should have known your rights. Police can not search you unless they have a warrant, unless they arrest you. You could have fully refused a personal search, it is your right. If you are even approached by police officers while high or carrying drugs, ask them if you are being arrested (officers are reluctant to arrest you without good cause). If you are not under arrest, tell them you are in a hurry and must be on your way, and then head directly home. Please, know your rights and liberties in your province, state, municiplity, country, etc. Also, if you are on government property (ie schools, or school playgrounds) police do not need a warrant or arrest to search you. Knowing your rights and liberties is key to never falling into legal trouble.

Now, i have never gotten to that point, but i am sure that 95% of cops will not wait an hour for a laywer to arrive. Being polite and curteous will usually get you through it. Just tell them that you'll be on your way and there will be no trouble.
