same here both times ive been arrested i got searched twice one on the street 2nd at the jail

havent heard anything so far so im hopin im in the clear on the herb sack. and to everyone saying he didnt show you a badge or he didnt read you your rights, while i respect your opinion and youre trying to help me out, i have had plenty of experience with police and bottom line they can do or make up any shit they want. my word against theres is worth absolutely nothing. my last arrest for felony intent was full of nothing but lies in the police report, its just the way it is. it makes me want to move to a deserted island. the human race is just disgusting. i will be calling a lawyer tomorrow. thanks all.

Since when can the prosecute the underaged person attempting to buy alcohol?

There was no illegal action done, you basically just asked if you can buy the beer. In Cali the STORE would get a $10,000 fine and the person if they sold it to you would have 6months-1year in jail I think. Either way you didn't do anything illegal. Shenanigans?

Really? If the officer asked his age and he lied it would make sense but I'm pretty sure you can go around telling people your as old or young as you like.

If he did purchase the beer and a cop asked to see ID after the transaction, then yes the OP and the seller would both in trouble.

But like i said the OP should not of self incriminated himself by showing his ID. He also shouldnt of gone with the off duty cop without seeing any identification.
I just graduated college for Criminal Justice, I used to think like many of you on this forum- that if you aren't read your rights the case gets thrown out as stated this is not true. They do not have to read you your rights unless they start asking incriminating questions.

"The kid didnt buy the booze, no money changed hands, therefore he did not commit a crime."- The simple act of him attempting to buy the alcohol is enough to have him arrested, it's called Intent. He intended to purchase something he could not legally obtain. It's called Mens Rae (thinking about committing crime) and Actus Reus (acting upon the thought of committing)

Looks like you caught a break with you riding in his SUV instead of squad car. After an officer makes an arrest they sweep through the whole car to make sure the person they arrested did not drop their "goods" in the vehicle. Depending on your state law and the amount of marijuana you have on you, the cop usually just takes the stash and you don't get charged for it. They will never fingerprint something like that by the way. The only time they would take the time to fingerprint something like that is at a crime scene, they would not waste time or resources of searching for someone who had possessed the marijuana, it is either in holding or they already smoked it.

if its not in your possextion its not your problem haha. your fine now man. just deny everything if they ask about it. they dont have proof you dropped it in there. if worst comes to worst say it was left there from the first time they arrested you hahahahah
