Can school resource officers random search you?

My brother has been tripping the fuck out. Today he got a dealer's number at the bus ramp or something, hes in highschool. And he tells me that one of the resource officers were looking at him, and when he got on his bus, she called him out and asked him why he needed the guy's number.

All he said was that they were doing a project for spanish, but heres the fucked up part; he said "Oh i know _____ sells weed, but i don't do that stuff" Instantly i wanted to slap his ass for ratting out the kid, but.... :confused:

Anyways, hes scared now that they will random;y search his ass tmmrw, can they do that for no apparent reason? Like...umm lets see..if its like the middle of the day, can they just call him out to the front office where they will search him? I mean i doubt this is likely, but do they have to have probable cause to search like REAL cops?

The first step to your world peace would be to somehow stop war.

Not some placebo such as weed, violent people will still be violent if they smoke weed.

at my highskool (im a senior btw) they can search u if they want. theres a sign that says upon entering this faculty school officials ccan search u or ur vehicle. or some shit like that. but we also have a skool cop and yea. im pretty sure all schools can search the students if they think they sell drugs

I don't know the exact laws but when you enroll in high school you give up a LOT of your rights. But I'm telling you from first hand experience that bringing weed to school is the DUMBEST THING YOU CAN DO!! Seriously, just don't do it. Especially if you think someone from the school is on to you. The high school I went to made the lives of some of my fellow students hell just because they knew they were dumb enough to bring shit to school and then keep bringing shit to school.

So basically my advice to you and your brother and his dealer would be to not take shit to school. If they really must, they should at least hold off on it for a while. Don't have to stop smoking, just stop bringing it to school. They can't do shit if you don't have it at school.

if its a public school they can search you for no reason.
to get legal, they can search you but they can't go overboard. i.e. say school ends at 3, they cant take you into the office, search and question you and hold you past 3, but because in school your actions are limited and your whereabouts, for the most part, predetermined, they can hold you within school hours.

if public school, he can be searched. so long as he doesn't have weed on him he's fine.

Doesn't mean you have to let them search you.

Maybe it was just my ghetto high school but with all the stairways and halls it was easy to loose the security when they wanted to get you. Plus with 3000+ kids they would rarely remember you escaping the next day.

Yes, it will work, but only do this if you actually have drugs on you because you will most definitely get suspended for insubordination.

School is not prison, the rules at a public school are not superior to the Constitution of the United States, which the 4th amendment gives you the right to stop unlawful searches and seizures. With no probable cause, your car cannot legally be searched.

Think about it, what's worse, getting suspended for not listening to a school official, or getting suspended the same amount of days for drugs where it will be handed over to the police and be on your permanent record as suspension for drugs. The drugs on your record look worse when applying to college, and if you had to explain the insubordination suspension, you could of just said you really respect the constitution.

But if you don't have anything on you it would be wise to let them search your car.

Shit, whenever I was in school and they called me down to the office, I would IMMEDIATELY grab all my shit and hop the fence in order to go home. No evidence, no punishment :smoke:

Here's an easy solution: Don't go to school with stuff that could get you in trouble! At the very least, wait until you know your in the clear. Seriously, you (your brother) can wait 6-7 hours to toke up.

If you are a student in a public school, you are bound by an adhesion contract known as a school registration. Adhesion contracts are take-it-or-leave-it contracts you can only volunteer into. Once you volunteer, you are bound by the rules of the contract, many of which are not readily acknowledged. The rules can also be changed at the will of the school administration without your consent.

Essentially, you give up any and all natural (God-given) rights when you enter an adhesion contract with a municipal corporation.

Well... If he actually had it on him, then they will have a greater chance of finding it. Police can search your outer clothing for weapons, so you see where I'm coming from. Where else would he question them searching him? His locker? No, the school owns that, but the car is your property. Any other locked places that are commonly searched?

Also, they can't violate the 4th amendment without you agreeing to give it up. Like the person above me said, you can break the contracts that you signed, and your right they could remove you from the school, but they would have to be hearing first to, so are they really going to expel you for insubordination?

At the least, if you have serious drugs in your car that the cops will charge you with, don't consent to the search is all I'm saying. They literally need a warrant to search your property, if it is locked, without probable cause.

I know what I'm talking about, you don't just loose your rights because you are at a school. With that said, you can get in trouble by the school for not following their rules, but my info will help if you are legally worried about getting in trouble with the law.

So yes, I know what I'm talking about, the supremacy clause clearly states nothing is more powerful than the constitution, so you still can choose to exercise your 4th amend. rights.

I don't really know I've never personally been searched at my school. I've know people that have gotten searched.

Thats the whole point though. Many people do get expelled because they do not consent.
Its a lose/lose situation for the person attending.
