So, friend of mine (a minor) has been busted at school for the second time, this time they called the cops. He lives in Ontario. He had about 2 grams and a couple pipes. He was suspended and will be receiving a court notice within the near future. What can he expect out of this? Should he hire a lawyer or stick with some court-appointed attorney? Should he bother bringing up the fact that a Canadian Senate committee recently declared Canada's marijuana laws to be unconstitutional or that case out of Windsor where a teen caught skipping class with 5 grams was found not guilty on the same premesis? or should he just plead guilty and hope for a discharge?

Talk to your lawyer or public defender (if you get those in Canada). I'm not clear on Canadian law, but since you're a minor you'll probably just get a small fine and a slap on the wrist. As well as maybe a behavior contract at the school you go to.

go to normals web sight. they have defence attornies that specilize in marijuana. also check out the book "BUSTED!" by M. Chris Fabricant

straight up your boi don't got shit to worry about.. were in CANADA my friend cops smoke weed up here.. i'd say absolute worst that could happen community service or some sort of drug program were hes gotta go once or twice a week for a certain number of hours.. still find a lawyer call him up n see wats good

Wouldn't a lawyer cost my friend more than what a fine would be? Would he be better off just with a public defender?

and what is the consensus on this site: http://www.thepotlawhasfallen.ca/

1) Is that legal defense kit actually credible/effective, or would it just look like he was trying to worm his way out of it, thus incurring the wrath of the justice system?

2) Any thoughts on bringing up the unconstitutionality of Canadian cannabis laws, or would he have to appeal to a higher court before they would consider that sort of thing?

3) And would public defenders cover my appeal, or would he be on his own for a lawyer for that sort of thing?

Well YOU should get a public defender if they give you one man. Talk to them about it, not us. Every judge is different man, even if the laws are the same, the judge can rule different punishments for the same crime even. good luck man, youll be fine your country is pretty lax on the weed laws.

He has not received his court notice, but the not-so-friendly cop said that he would be contacted in the next little while. When will he find out who is public defender is and how to contact him or her? From what I have heard, public defenders for the most part just have a quick 5 minute talk before the case goes to court, and then just basically goes through the standard routine.

yeah thats how it normally goes, but he might be able to contact one and question them. Or possbily call up a lawyer and (since "he"'s underage, he could ask if he could just give him an estimation on whats happeneing. Make sure you let him know BEFORE you talk about your case that your just looking for advice, and that your underage and cant afford a lawyer. My homeboy did that and he gave him advice for free.

I got my house raided and the cops found 6 pounds and a little under 47 grand cash....and i got off with probation. Here is what i would do if I was him. Fuck the court appointed lawyer they suck. Second have him start going to Narcotics Anonymous meetings and make sure he gets his sheet signed tp prove he went. Also stop smoking and start getting drug test done by a hospital facility to show what he is staying clean. What u want him to do is be pro-active to show the judge that he wants to change. I mean these are a few of the things that I did and it helped me out....thats about all I could tell you

ya your probably going to get a slap on the wrist and a lawer would probably cost more than the fine. i know people in the states that have been busted for parinphilia and possesion several times and its always just the fine. they give him more shit for his minor consumption than the weed!

actually where i live the fine for weed is half of the fine for alcohol... tells you how much they really care about weed.

and people get cought growing and the cops wont even take the plants (if its only one or two) they just say make this your last grow! fucking sweet
