what would you do if you were in this situation?

you just hot boxed your car, a couple minutes later as your cruising a cop pulls you over, asks for registration and ID, and then he smells it...

he asks who's been smoking pot, and to hand it over to him. he states that if you hand it over then he'd pretend it never happened, and let you go.

what would you do? trust the cop, and hand over the weed or just deny everything?

That's funny man cause I've been through a similar situatoin. Me and a friend just finished a blunt and my car was hot boxed as hell. A cop hits us with his light, comes over after a few minutes, asks us what we are doing and my friend immediately tells him we've been smoking bud. It's obvious right? He asks us if we have anything else, we say no. He says if he searches us and finds nothing then he'll let us go, if not then to the station we go. He found nada and we went free. I think it was cause we were honest, weed is so minor and didn't have anything else on us. But that was just one situation, I think we just got a somewhat cool cop and we didn't have anything worth his time. There's no use in trying to deny you were smoking weed when your car is already boxed right?

It wouldn't be entrapment, the cop has not make you be in possesion of the weed; so yes I'd assume.

If my bud was well hidden within the car, then I'd deny...he could search regardless due to the smell. If however it would be easily found then I'd hand it over probably, and hope it's a cool cop.

Entrapment means that the cops made you smoke the weed/commit the crime ^^ If you handed if over to him after he said he would look the other way, and he arrested you.. you my friend have a asshole cop.

well, if he already smelled it, he would automatically be allowed to search the car. so, i would hand my bag over. because if you denied it, and he was an ass and searched your car, you'd get in more trouble i think. but since i live in California, i would take the chance and not hand it over if i were in possession of more than an O.

maybe, but i could've sworn i've read something saying that if the cop smells it, then that's probable cause for a search. i could be wrong, though.

Ever heard of the patriot act my friend? Cops don't even need to smell it, they can just say they do. If a cop really wants to search your car, he's gonna do it and get away with it. Whether it violates your rights or not. And it will hold up in court. If the cop says he smelled weed the judge is going to believe him before he would ever believe you.

And to the OP, I would just hand it over to him unless you have it hidden very well. Because he's gonna search you and find it anyway. So if he is lying then you aren't any worse off then if he just searched you and found it.

If I had weed in my car and a cop told me he would let it go if I handed it over I'd probably hand it over, especially if he smells it and you just got done hotboxing the thing.

ahh, if only i knew this a couple days ago...

the exact situation happend to me, and i denied it, he told me to get out, and searched me, and found my half 0 in my right pocket.. :'(
