Am I liable for this?

Okay here is what happened: My school plays a game called assassian. You and a partner are assigned a "target" which is simply members of another group. Your job is to eliminate the target team by getting them wet. You can use a water balloon, squirt gun, bucket, etc..

So as I was coming home from school, I saw the person trying to assassinate me waiting in front of my house in her car. I drove out of my street and to my friends house and parked in his driveway and went into his house. I got 2 water balloons ready and waited to see if she would find me. About 10 minutes later she returned and was waiting out in front of my friends house sitting in her car. I ran outside and threw the first balloon and missed. At this point she was sitting in her car with the window rolled down trying to squirt me from about 30 feet away. So I chucked my water balloon and it exploded on the front dash of her car, soaking her and her friend.

She texted me an hour later and said her sound system wasn't working in her car and said that I would have to pay for it to be fixed.

My question is am I liable for those damages?

I think no because she knew that by playing assassian she assumed the risk that she was going to get wet. Also she was dumb enough to sit in her car with the window open while I held a water balloon in my hand

If she is squirting water from her vehicle at you I'd think you're good

She chose her attack location, she should have chosen better. Perhaps your whole group of players should convene a council to overview the situation? Maybe everyone kick in a few bucks and warn everyone they are no longer liable and/or add some off limit areas.

there are safe zones. They are when you are at school, work, or any religious institution

we had this same game in high school. i ended up winning it with my team, and we won 2 grand. fuckin good times man. bought a bunch of ganj with that money

We had the same game at my school during senior year, we didn't have teams though. I got about 3 "kills" and then got killed. It was fun as hell, though... I wish I had been high for it. Then I would've been paranoid enough to not get killed.
