When is sex considered rape?

So I was watching the news about a new case that came before the Maryland court.

To sum it up:

Two people are having sex, the woman says stop, the guy stops 5 seconds later and is charged with rape.

"Objects in motion will remain in motion"

I mean, thats just fucked up, 5 second rule.

I don't condone forcing sex on anyone at all but if they were doing it he may not have heard the first time or may have thought she was moaning or something..

in my opinion he stopped when he realized she wanted him to.

Ridiculous. He could have been overtaken by the moment and just realized what she said a few seconds later. Sometimes it takes time to process something.

Most of us agree rape is wrong. What we're all saying is thats fucked up that hes in jail for not stopping 5 seconds from when she said stop and she charged him with rape and won the case and he's in jail.

I always thought it was considered rape when alcohol and denial were involved.

This begs there question where the cut off point can be drawn. It is impossible to stop instantaneously, does therefore stopping 1 second constitute rape? Pretty much possible to get anyone convicted of rape if so. This is just rediculous and demonstrates the flaws in many judicial systems.
