The judges are being deliberately short-sighted.
They're making the assumption that all marijuana use "places the lives of others at risk". As the ruling relies on this assumption the judges should be forced to prove it's validity. If there's no statistically significant difference in the level of risk placed on others by smokers as opposed to that placed on others by nonsmokers then this ruling should be overturned.
