CO Health Board to vote on Tuesday (11/3) to Weaken Medical Marijuana Law


**EMERGENCY ALERT-- PLEASE FORWARD WIDELY**

In an underhanded move, the Colorado Board of Health will be voting to weaken the medical marijuana law at an "emergency" meeting on Tuesday, November 3 at 10:30am in Denver. At this stealth meeting the Board will be voting to redefine what a "caregiver" is to require such individuals to provide supplementary-- and often unnecessary-- services beyond simply providing sick patients with medical marijuana.

"This is like requiring my pharmacist to give me a massage or make me a sandwich," said Dan Pope, muscular dystrophy patient and medical card holder. "I can do those activities myself. I need a caregiver to give me medicine. End of story."

This meeting, which was announced in a late afternoon email to a small handful of patient advocates, is another example of the state engaging in underhanded tactics in their effort to undermine the medical marijuana law and the will of the Colorado voters. Please help hold them accountable.

Here's How You Can Help:

(1) Attend the Meeting. This meeting will occur at 10:30am on Tuesday, November 3 in the Snow Room, 1st Floor Building A of the Colorado Department of Public Health and the Environment, 4300 Cherry Creek Dr. South, Denver CO.

(2) Call-in to the Meeting. While we strongly prefer that you attend in person, you can also call-in at 1-866-899-5399, conference code *3529725*

(3) Spread the Word. Please tell friends and family to attend the meeting and forward this alert widely!

didnt we just have a hearing about this???!! you know the one at the tivoli? if they vote whatever they are trying to pass will it be immediate?

As of right now the new ruling has gone into effect. All caregivers/dispenseries looking to be in compliance with state law need to be providing OTHER caregiving services as well. (Massage, RN type services, elderly care, transportation, etc.)

The meeting was barred to all but the first 20 people and the teleconference was being constantly bombarded by someone playing music into their phone, stopping anyone outside from hearing the meeting.

I'm going to listen to marijuanaradio tonight and see if they have any more information about what went down today. Catch the show at 7 mountain time Tuesdays.
As of now the only information I've seen if form the local news, not a very trustworthy source.

The board refused to listen to public comment and unanmously approved their proposal to remove the verbage they added in July. AS it stands now the definition of a "primary Caregiver" is as written in the Amendment 20 law. And because of the Colorado Court of Appeals ruling last Friday, stating that a cg must do more the supply MMJ, it is now recommended that all cg give more service to their patients then mearly suppling MMJ.

"Once again, we're under the fear of having our retail operations or growing rooms," said Nederland marijuana dispensary owner Mark Rose. "People, the government coming in and arresting us."

"What we saw here today is not democracy," said lawyer Corry, "This is government by illegality, this is an end run around the law."

But the Board says it was left with no other choice.

The Board has set December 16th for a full public hearing and final decision on the marijuana ruling.

So pretty much all a dispensary needs to do to stay open is SAY that they're providing other services. They really only need to hire on a masseuse or something, even if he doesn't ever actually give massage therapy. Way to get 'em Government. Lol, I'm really not even worried. I can almost guarantee that most dispensaries will offer the other services but continue with mainly just selling the medicine. Fucking joke.

How about people not going through a dispensary and using a private (w/rec.) grower? Or to put it another way a medicinal patient buying form another medicinal patient/grower? A patient growing for 3 or 4 or 8 other patients can't offer other medical services.

This is like putting the mom and pop's out of business and requiring large dispensaries that can offer supplemental caregiver services .... exactly what the state seems like it's trying to get away from.

It does NOT mean other medical services, just other services.
As a cg you have to KNOW your patient and do something besides sell them MMJ. Weekly contact, a visit to their home, check for safety issues around home, nutrition, Dr rides and so forth.

I would visit each patient, buy them a burger or bring a snack.

The Courts ruled that not knowing your patient and selling through a disp isn't going to fly.

So if they deliver and if they bake me some edibles then we'd be good under the law - it would seem?

It will be interesting to see how this all plays out in the coming weeks.

I'm not going to my 11 o'clock class just so I make sure they don't do this. I can find my own bud, but the dispensaries are the main source of it. They just need to not fuck with something good.
