I did argue the vicodin point as well as others (adderrall, cylert ridalyn etc.) HOWEVER because those medications are given a certain mg dosage they are allowed there is no dosage laws pertaining to his MMJ (this is the schools argument anyway) so there is no control over the dosage/potantcy only the amount allowed to posses at any one time (1.5 lbs). Yes this is a state funded school with a state recognized MMJ card(Oregon) Vice P stated this is a first for them to have to deal with and apologized that they had to expell him, but it was a superintendants decision, now we have to go before the expulsion board around December 3rd meanwhile my son looses out on his education.....*sigh* | |

I feel for you, I really do. The public school system is not half of what it used to be in California, I can only imagine other states have it just as bad. These days, I wonder if an educated parent could home school a High School age teenager better than the public schools. Hell I was thinking about becoming a teacher and actually have all the credentials and credits I need to substitute right now.

Well, public schools are better than private schools. I've got some stories on that note.. I do think home schooling is a good idea these days, especially with the way the world is going now. It is true that you can't medicate on school property. My mom had to send letters and get a lawyer just to have the school hold my medication at the front desk so I could take it during my lunch break. Even then, I had to sneak the pills in for a year before they let me have them. |

Well if the school is public then it is probably receiving federal funding which would generally mean that federal laws would come into play...if the school is public then this could be an interesting case. I would just speak with a mmj friendly attorney to look at your legal options. Best of luck to you and your son

Well looks like Im gonna have to do this all on my own, no one will touch this one.... But did get recomendation from Oregon Department of Education to file a complaint that other students are allowed to attend school without the threat of expulsion, and that it made no sense (to this person) that the school would OK one medication perscribed by his Dr. Vs the MMJ permitted by the state recomended by his Dr. So did that no response yet..lol didnt expect one really. So then I get the letter of recomendation for expulsion stating that he is being heard by the board for being under the influence of drugs/alcohol or tobacco on campus. These rules are listed in the RRHS handbook. OK so I looked and the handbook states: The RRHS standard of conduct prohibits the unlawful possesion, use or distribution of illicit drugs and alcohol on school premises or as part of any activities. Nothing about being under the influence. Interesting because I say that my son was LAWFULY medicating at home and did not violate the standard of conduct as he did not posses, use or distribute his medication on school premises. ![]() Now the somewhat funny part, they offered my son to go to school with the following adhersions 1.No open campus/driving privlidges 2.The next violation of code of conduct (Tabacco/Alcohol/drugs) will result in immediate expulsion 3.He will enroll in Ontrack, be evaluated, complete thier rehabilitation process and maintain negative test results which will be provided to RRHS 4.He will be randomly drug tested throughout the year at my expense the results will be communicated to the principal he will have full access to any information. how can they send him to rehab for a medication prescribed by his doctor?? thats the not funny part any suggestions?? By the way THANK YOU ALL for your support and input on this.

to answer your question: They can send him to rehab because it's part of the only way you can get him back in school. And as for the drug testing: if they want it done, in the state of Oregon, they must pay for it themselves. But if you already agreed to it... then unfortunately there is nothing you can do.

| Re: medication and school I know il get flamed for this n all but he is under the influence? How would you feel if you got on a bus and the bus driver was stoned? As far as i can see it rules are rules.

no not completely flamed lol...I agree, however when they show me the rule that says he cannot be under the influence in writing then I may stand down THERE ISNT ONE it clearly states just possesion, use and distribution ON school property they are making it up as they go along. Bus drivers cannot take vicoden and drive, (CLEARLY states on the bottle do not drive or operate heavy machinery) but a student can take vicoden and go to school. Come on now, hes not putting anyone in danger, he sits at a desk, why can his teacher come to school medicated with the same card? The stoner can teach but the stoner cannot learn? BS! Barofilian:: NO I have not agreed to ANYTHING, we go before the school expulsion board on December 3rd, this is just 1 offer they are offering. And do you by any chance know if there is anything in the 2007 OR statutes I may be able to refer to on that?
