The American Psychiatric Association supports medical marijuana. Is the doctor a member of the association? How could he disagree with his own medical board?

California Appeals Court: MedMJ patients need not get doctor renewals


Ruling overturns Redondo medical marijuana decision - The Daily Breeze
Three justices from the 2nd District Court of Appeals decided Wednesday that state law does not require “a patient to periodically renew a doctor’s recommendation regarding medical marijuana use.
In addition, the justices ruled that it should be left to a jury to determine if the amount of marijuana a patient possesses is related to their medical needs or exceeds the law.
[Christopher] Windus, 39, was arrested Dec. 14, 2004, after police officers searched his room at the Palos Verdes Inn and found approximately 1.6 pounds of marijuana.
Before his trial began, Windus tried to convince Torrance Superior Court Judge Andrew Kauffman that he should be allowed to present a defense based on California’s Compassionate Use Act of 1996.
In 2003, the state Legislature clarified the law to allow qualified patients or caregivers to have no more than 8 ounces of dried marijuana with a doctor’s recommendation.
Dr. William Eidleman told the judge that he consulted with Windus in 1999 and 2001, and gave him written recommendations for the medical use of marijuana for chronic back pain.
Eidleman said Windus ingested marijuana, which requires four to eight times more of the drug than smoking it. He said it would be appropriate for Windus to have 3 to 6 pounds of marijuana in his possession.
After hearing from the witnesses, the judge said he found Windus was legitimately a medical marijuana patient, but that no physician had recommended he possess more than 8 ounces of the drug at any time.
This week’s decision overturned Kauffman’s ruling and sends the case back to the trial court level
The California courts decided earlier this year that SB 420, the bill that limited patients to eight ounces, was unconstitutional because the legislature does not have the authority to amend an initiative passed by the people. They’ve also given quite a bit of deference to the doctor-patient relationship and resisted attempts by lawmakers to thwart medical marijuana, like we saw in the decision last week in San Diego forcing that county to issue state-mandated medical marijuana ID cards.
If only our federal courts were so understanding…




So you DO NOT have to go back every year. Recommendations do not "run out".

I still recommend one last visit, though. You need to get the doctor to put in writing on your recommendation the amount that you are allowed to possess AND the number of plants you are permitted to grow. Just remember, many cops are STILL going by the 6 plant rule- even though that is unconstitutional! But the doctor's recommendation on amounts trumped the state "limits" even before they were thrown out! Now the doctor's word is the only valid limit!

the shrink doesnt want to. Reason? She tells
me that there are studies that 'prove' that mmj exacerbates
anxiety within up to 48 hours after having last smoking it
(i call bullshit due to my own personal experience),
and that it can make the anxiety worse than it was before.

California has the largest number of legal MMJ users, so it is most likely that he is a Californian.

Most cannabis studies dealing with anxiety are done in the elderly suffering dementia, or in schizophrenics. CBD seems to be the more important chemical. THC alone can cause anxiety in some folks, but the CBD mellows things out. (Needs a "creeper weed") Most of the cannabis today is bred for THC alone, really high level CBD cannabis is rare.

The bottom one says kids using alcohol are more likely to experience anxiety than kids who use cannabis.



He needs to do a search on ANXIOLYTIC EFFECTS OF CANNABIS. May take a while, but he should be able to find a few more to add to the above. The abstracts (a summary of the study) are usually "in English" rather than "sci-speak", so look for them.

so why dont u just argue with the doctor about how well its worked for the last year and that its ridiculous for him to argue about it now. Unless he has seen examples of your anxiety in the last year, in which i think its understandable that hes arguing.

Imo mj can exacerbate the symptoms of anxiety, by making you ok with not being social, leading to more antisocial anxiety. So i think its a valid concern. Though if that isnt happening to you, argue through your words and not just studies, but personal experience.

If the regular doc is prescribing you medication for your anxiety, all you need to do is provide the prescriptions to the cannabis doc to get renewed. It shows you are being treated for the same said medical condition. Whether or not you choose to use their meds, is up to you. Just accept the prescriptions as proof, you don't have to fill the prescription. Dig?

It does help your legitimacy if you renew your cannabis recommendation annually, though.

bubblefunk i tried that going in there. they said i was high risk due to my age (nice),
and that i need my main shrink's approval. It allegedly goes against the place's policy (mmj) and that is why i need to convince them. Not argue

And that is not going to happen.
Apparently your Doc (thinks he) knows it all and will not allow you to 'underdig' his authority by convincing him about something he should know about on his own in first place.

You need to move on to someone else to succeed.
