I believe they're illegal in any form in the US, but the spores are only "for research purposes." I think its in europe where they're legal fresh but illegal dried.

Mushrooms arent illegal per se, but the psilocin and psilocybin are. Spores are legal because they contain no drug. You can get away with having WET shrooms if you can convince the authorities you picked them by accident. The only way that would probably work is if you had fresh psilocybin containing mushrooms as well as other fresh non-psychoactive species in your possesion.

EDIT: They are also illegal to cultivate. Spores are for microscopy only.
