Ohio's new paraphernalia law still sucks!

  1. Everyone needs to read deeper into this law. All it does is take away the jail time. It is still mandatory suspensions of your drivers license for 6 months to 5 years. Also you can be put on probation if the judge wants to. Just talked to my senators office and she cleared that up.



    Sec. 2925.141. (A) As used in this section, "drug paraphernalia" has the same meaning as in section 2925.14 of the Revised Code.

    (B) In determining if any equipment, product, or material is drug paraphernalia, a court or law enforcement officer shall consider, in addition to other relevant factors, all factors identified in division (B) of section 2925.14 of the Revised Code.

    (C) No person sha...ll knowingly use, or possess with purpose to use, any drug paraphernalia that is equipment, a product, or material of any kind that is used by the person, intended by the person for use, or designed for use in storing, containing, concealing, injecting, ingesting, inhaling, or otherwise introducing into the human body marihuana.

    (D) This section does not apply to any person identified in division (D)(1) of section 2925.14 of the Revised Code, and it shall not be construed to prohibit the possession or use of a hypodermic as authorized by section 3719.172 of the Revised Code.

    (E) Division (E) of section 2925.14 of the Revised Code applies with respect to any drug paraphernalia that was used or possessed in violation of this section.

    (F) Whoever violates division (C) of this section is guilty of illegal use or possession of marihuana drug paraphernalia, a minor misdemeanor.

    (G) In addition to any other sanction imposed upon an offender for a violation of this section, the court shall suspend for not less than six months or more than five years the offender's driver's or commercial driver's license or permit. If the offender is a professionally licensed person, in addition to any other sanction imposed for a violation of this section, the court immediately shall comply with section 2925.38 of the Revised Code.
     
  2. maybe it does suck but id still rather not have the possibility of going to jail 30 days for a pipe thats nice i dont care what anyone says improvements improvement better than nothing
     
  3. Ohio has always been interesting in that regard. They've had weed decriminalized since the 70s, yet pipes just recently get decriminalized to an extent. Is the "message Ohio is sending our children" really "Smoke a joint, not a pipe!"?

    That ain't cool.

    @OhioRevolution-The problem is a cop used to bust you with both but only write up the possession ticket and just destroy the paraphernalia to save on the paperwork and hassle of an M4 for a mere pot smoker, at least as long as you weren't a complete dick to the cops. Now they will just write the extra ticket and you get stuck without a license. F'ing mandatory minimum 6 months suspended license bs.

    @GreenDevil420-If they find you with weed and papers those papers are considered paraphernalia just as if they were a pipe. It would fall under a material intended for use in the inhalation of marijuana stated in division C. If you roll your own cigarettes and you carry loose tobacco you may be able to avoid the paraphernalia charge for papers, but even then it's all up to the cops discretion.
